Zoning Board of Appeals Minutes July 22, 2015
A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, July 22, 2015 at 7:00 p.m. at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following application:
Application of Daniel T. Byers, 8 Curtis Street, Jamestown, New York for a Special Use Permit for a camp on property on the corner of Donelson Road and South Main Street Extension, Jamestown, New York. Property is owned by him and is known as Section 438.00, Block 2, Lot 26 of the official tax map of the Town of Busti. Property is in the Conservation/Agricultural District. Mr. Byers was in attendance and explained his intention to use the property for family recreation, primarily in the summertime. The issue of the use of a camper on the property was deliberated, with the Board determining that such use is not expressly permitted in the town code. The Board indicated that building a permanent structure on the property could be permitted, subject to Board review and approval, and that Mr. Byers’ application could be tabled to allow him an opportunity to explore that option. It was noted that three neighbors expressed concern about noise and the use of the property via personal letters. Mr. Robert Whitman made a motion to table the application of Daniel T. Byers until the next scheduled public hearing before the Zoning Board of Appeals. Seconded by Tim Young. All aye. Carried.
Upon motion made by Robert Whitman and seconded by Doug Hooper, the meeting was adjourned at 7:30 p.m.
