PRESENT: Attorney Joel Seachrist and Town of Busti Inspection Officer Jeff Swanson Chairman David Paterniti opened the meeting at 7:00 p.m.
Chairman Paterniti reviewed the motions from September 2nd‘s Planning Board meeting on the application of Southern Tier Brewing Co. for Phase 3 and Phases 4 &5. He noted that the site plan has been modified to eliminate the encroachment on the wetlands and the application was referred to Chautauqua County Department of Planning & Economic Development who found the project to be a matter of local concern. The department encouraged the town to reevaluate the appropriateness of its minimum parking requirements for warehousing uses in the Industrial District. Mr. Paterniti added that upon reviewing the application Attorney Joel Seachrist determined that it should be referred to the Zoning Board of Appeals for an area variance requesting a reduced number of required parking spaces. The ZBA met on September 23rd and granted a variance to reduce the number of required parking spots from 150 to 35 additional spots. Combined with the existing parking spots there will be approximately 45 spots for the facility.
Attorney Seachrist reviewed the SEQR documents and the Negative Declaration. The following approval was adopted:
RESOLUTION
Moved by Janet Briggs , seconded by Michael White :
WHEREAS, Southern Tier Brewing (hereinafter, the “Applicant”) has submitted a building permit application that would allow it to construct three new 150’ x 150’ buildings in the Stoneman Business Park located on Stoneman Circle, on a parcel designated on the Chautauqua County tax map as Sections 385.00, Block 1, Lots 44.1 and 45.5, and
WHEREAS, the Town of Busti Zoning Code requires the Town Planning Board to conduct site plan review for new commercial and industrial buildings, and
WHEREAS, the proposed site plan has been subject to environmental review pursuant to Article 8 of the New York State Environmental Conservation Law (State Environmental
Quality Review Act), including the preparation and review of a short Environmental Assessment Form, and
WHEREAS, Part 617 of the implementing regulations pertaining to the State Environmental Quality Review Act requires this Board to determine and give notice of the environmental impact of the proposed plan, and
WHEREAS, the Board has determined that the proposed plan will not have a significant environmental impact,
NOW, THEREFORE, BE IT RESOLVED, that the Town Planning Board hereby approves Parts I and II of the Environmental Assessment Form, issues the attached Notice of Determination of Non-Significance, also known as a Negative Declaration, for the proposed use, and authorizes the Chairman to complete and sign the Environmental Assessment Form accordingly.

James Butler motioned to approve the modified plans for Phases 3, 4, and 5 for Southern Tier Brewing Co., Inc. to construct sprinkled additions to the current warehouse noting that the modified plans eliminate encroachment on the wetlands, a SEQR has been completed and a Negative Declaration adopted. Motion was duly seconded by Janet Briggs.
