Zoning Board of Appeals Minutes September 23, 2015

A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, September 23, 2015 at 7:00 p.m. at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following applications:
Application of Dan Nagle, 1 Edgewood Drive, Lakewood, NY for an area variance for a sunroom addition. Property is owned by him and known as Section 385.03, Block 1, Lot 21 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Tim Young made a motion to grant the application of Dan Nagle for 6’ relief on the south boundary for a 16’ x 16’ sunroom addition. Sunroom is to be no closer than 44’ to the southern property boundary. Seconded by Richard Nygren. All aye. Carried.
Application of John M. Salvaggio, 4071 Baker Street Extension, Lakewood, New York for an area variance for a garage addition. Property is owned by him and known as Section 402.00, Block 1, Lot 44 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Richard Nygren made a motion to grant the application of John M. Salvaggio for a 12’ x 30’ addition to the back of an existing garage. Addition is to be no closer than 20’ to the eastern property boundary. Seconded by Tim Young. All aye. Carried.
Application of Southern Tier Brewing Company, 2072 Stoneman Circle, Lakewood, New York for an area variance to permit a reduced number of required parking spaces for a warehouse on property owned by them and known as Section 385.00, Block 1, Lot 45.5 of the official tax map of the Town of Busti. Property is in the Industrial District. The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Tim Young made a motion to grant the application of Southern Tier Brewing Company for a variance to reduce the number of parking spaces to 35. Seconded by Gary Starr. All aye. Carried.
