A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, January 27, 2016 at 7:00 p.m. at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following applications:
Application of Gerald N. Paddock, 102 Lakeside Boulevard, Jamestown, New York for an area variance to erect a storage shed on property owned by him, located at 4736 Ashville Road, Ashville, New York and known as Section 384.11, Block 2, Lot 2 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. The Board reviewed the application and confirmed with Mr. Paddock that there is currently no house on the property. Because the Town Code specifically prohibits accessory structures on property where there is no house/residence, the Board informed Mr. Paddock that they could not consider his application any further, and no official action was taken.
Application of Busti Church of God, 996 Forest Avenue, Jamestown, New York for a special use permit to install a generator on said property. Property is owned by them and known as Section 420.00, Block 3, Lot 37 of the official tax map of the Town of Busti. Property is in the Conservation/Agricultural District. Bill Weaver, representing the church, explained where the unit would be placed on the property. He noted the dimensions are approximately 4 ft long x 2 ft wide x 29 inches high and that the noise level is 63 decibels, which is equivalent to the average dishwasher. The unit will only run once per week for 15 – 20 minutes for a test cycle. Douglas Hooper made a motion to grant the application of Busti Church of God to install a generator at 996 Forest Avenue, to be placed 5 feet from the building. Motion seconded by Tim Young. All aye. Carried.
Upon motion made by Robert Whitman and seconded by Douglas Hooper, the meeting was adjourned at 7: 25 p.m.
