REGULAR MEETING
July 18, 2016
A regular meeting of the Town Board of the Town of Busti was held on Monday, July 18, 2016 at 6:45 p.m., at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York with the following members present:

Councilman Kenneth J. Lawton

Councilman Todd M. Hanson
Supervisor Robbins called the meeting to order with the salute to the flag and a moment of silence was observed.
Present at the meeting were: Highway Superintendent Melvin Peterson, Lakewood Busti Police Chief John Bentley, Attorney Joel Seachrist, Code Enforcement Officer Jeffrey Swanson, Susan Lane, Lee Fischer, Ray Ayers, Tillie Solomonson, Joyce Roof, Charles Roof, and Ryan White – Southwestern Soccer Club.
Susan Lane, Village of Lakewood Historian, reported the Lakewood Historical Museum has a new video “Lakewood, Then and Now”. The video runs approximately 20 minutes and Ms. Lane would like to set up a time for the town councilmen to view it. The Chautauqua County History Fair will be held in August. Ms. Lane would like the town board’s permission to hold walking tours of the Bentley Cemetery in October at no charge.
Supervisor Robbins moved to allow the Village of Lakewood History Museum to hold walking tours in the Bentley Cemetery during the month of October 2016, motion was seconded by Councilman Mueller.

Lee Fischer inquired about the board’s intent in surveying the town property in Cottage Park. Supervisor Robbins explained a survey was necessary to determine the boundary lines of town property before any clean up was done by the town. There was a question if certain properties had deeded rights to town property in the Cottage Park area. Attorney Joel Seachrist stated he would need to research that question before he could comment on it.
Joyce Roof inquired about a house that is in disrepair in the Hamlet of Busti. Supervisor Robbins noted that the town is aware of condition and is working with the owner to remedy the situation. Mrs. Roof also questioned why residents are not allowed to sell pies on a street side stand. CEO Swanson stated that such sales fall under Chautauqua County Health Department and any questions should be referred to the department.
Ryan White, Southwestern Soccer Club, reviewed the plans to build a concession stand at Loomis Park and the grant applications that are being submitted to the Sheldon Foundation, Lenna Foundation, and Chautauqua Region Community Foundation. He and Highway Superintendent Peterson have met and reviewed the plans and location of the concession stand.
Town Clerk Darlene Nygren reported her office has sold 719 Transfer Station Stickers; no one has applied for the Dog Enumerator position; M&T Bank has notified the town they will begin charging for banking supplies and Lock Box Tax Receipts as of January 2017; New York State Hunting Licenses will go on sale August 1st; and the new town website has been launched. Town Clerk Nygren will have refresher training and will then post any minutes that are not on the website, she asked the board to look at the website and let her know if there are any corrections that should be made.
Chief John Bentley reported 5,952 incidents YTD.
Highway Superintendent Melvin Peterson reported the department will be blacktopping on Pine Ridge Road, Wellman Road, Orr Street, and Mead Road – from Southwestern Drive and up the hill. The department will receive $33,500 for three years under Governor Cuomo’s program “Pave New York”.
Code Enforcement Office Jeffrey Swanson requested board approval to purchase 15 to 20 “Condemned Structure” signs at a cost of $15 each. The signs would be made out of plastic corrugated board and would be reusable. Currently he is posting laminated paper signs that are easily removed and don’t hold up in the weather. CEO Swanson stated that he believes the town should look into requiring Cell Towers to obtaining a Zoning Permit rather than a Building Permit.
Supervisor Robbins moved the following resolution which was duly seconded by Councilman Andrews,
RESOLVED, Code Enforcement Officer Jeffrey Swanson be authorized to purchase 20 “Condemned Structure” signs at a cost of $15 each.

Supervisor Robbins moved the following resolution which was duly seconded by Councilman Mueller:
BE IT RESOLVED, that the Town of Busti/30123 hereby establishes the following standard work days for these titles and will report the officials to the New York State and Local Retirement System based on their record of activities:

Councilman Lawton moved the following resolution which was duly seconded by Councilman Andrews:
RESOLVED, Southwestern Soccer Club is authorized to construct a concession stand at the Town of Busti’s Edward F. Loomis Town Park. The Town of Busti will act as the fiduciary for any grant applications submitted seeking funds to offset the cost of the concession stand project.
Upon roll call vote, all aye, carried.
Supervisor Robbins moved the following resolution, which was duly seconded by Councilman Mueller:
RESOLVED, Court Clerk Elizabeth Davis is authorized to attend New York State Association of Magistrate’s Court Clerks Annual Conference in Binghamton, NY, September 25 – 28, 2016 with all expenses to be paid by the town.
Supervisor Robbins moved the following resolution which was duly seconded by Councilman Mueller:
RESOLVED, that Supervisor Robbins be authorized and directed to pay the presented General Fund, Highway Fund, and the Joint Recreation Fund for Abstract No. 12 from warrant #399 to and including warrant #465 in the amount of $121,901.48.
Upon roll call vote, all aye, carried.
Supervisor Robbins moved to accept the June 20, 2016 town board minutes which was duly seconded by Councilman Mueller.

Councilman Lawton reported the LoCo Trail committee has received notice from Norfolk Southern Railroad stating the bike trail would not be authorized to be located on railroad right of way. The committee is now looking for other possible locations for the bike trail.
Supervisor Robbins moved to enter in to executive session at 7:45 p.m. for a personnel matter which was duly seconded by Councilman Lawton.

Supervisor Robbins moved to close the executive session at 8:27 p.m. which was duly seconded by Councilman Andrews.

Supervisor Robbins moved the following resolution which was duly seconded by Councilman Mueller:
RESOLVED, to set a public hearing at the Town of Busti Administrative Building, 125 Chautauqua Avenue, Lakewood, New York, at 7:00 p.m. on the 1st day of August, 2016, regarding the adoption of Local Law No. 2 of 2016 entitled “A Local Law to Supersede Section27 of the Town Law with Respect to Compensation of the Code Enforcement Officer”.
Upon roll call vote, all aye, carried.
Supervisor Robbins moved the following resolution which was duly seconded by Councilman Mueller:
RESOLVED, Supervisor Robbins is authorized to sign the Addendum to the Intermunicipal Agreement effective January 1, 2016; “Shared CEO Agreement” between the Village of Lakewood and the Town of Busti, provided Local Law 2016-2 is passed by the Town Board. The Addendum addresses the Division of Fees for Asbestos Inspections provided Local Law 2016-2 is passed by the Town Board.

Supervisor Robbins motioned to adjourn the meeting at 8:36 p.m., which was duly seconded by Councilman Hanson.
