A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, April 27, 2016 at 7:00 p.m. at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following application:
Application of John P. Strand, PO Box 424, Ashville, New York, to renew a special use permit to operate an existing self-storage facility at 4748 Cramer Drvie, Ashville, New York. Property is owned by him (Lakewood-Busti Properties, LLC) and known as Section 401.00, Block 2, Lot 3.2 of the official tax map of the Town of Busti. Property is in the Light Manufacturing and Research and Development District. Mr. Strand was in attendance and noted that, except for the addition of a third building in 2015, for which all required permits were obtained, no changes in the operation of the business have occurred. Robert Whitman made a motion to grant the application of John P. Strand to renew a special use permit to operate an existing self-storage facility at 4748 Cramer Drive, Ashville, New York. The permit will be issued as granted before and will be for a three year term. Seconded by Richard Nygren. All aye. Carried.
Application of Bruce Moore, 1435 Winch Road, Lakewood, New York, for an area variance to construct a fence on said property. Property is owned by him, known as Section 402.00, Block 3, Lot 60 of the official tax map of the Town of Busti and is in the Conservation Residential District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Richard Nygren made a motion to grant the application of Bruce Moore to install an 8’ privacy fence. The fence will be 57’ long and will be approximately 2’ from the north property boundary. Seconded by Robert Whitman. All aye. Carried.
Application of Kathleen Ebersole, 4877 Kortwright Road, Ashville, New York, for an area variance for an addition. Property is owned by her, known as Section 452.00, Block 2, Lot 46 of the official tax map of the Town of Busti and is in the Conservation Agricultural/Mobile Home Park District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Douglas Hooper made a motion to grant the application of Kathleen Ebersole to construct a two story, 24’ x 31’ addition to her home. Variance is granted for lot width and side yard setback. Seconded by Gary Starr. All aye. Carried.
Upon motion made by Tim Young and seconded by Robert Whitman, the meeting was adjourned at 7:23 p.m.
