REGULAR MEETING
October 3, 2016
A regular meeting of the Town Board of the Town of Busti was held on Monday, October 3, 2016 at 6:45 p.m., at the Town of Busti, Town Administration Building, 125 Chautauqua Avenue, Lakewood, New York with the following members present:

Supervisor Robbins called the meeting to order with the salute to the flag and a moment of silence was observed.
Present at the meeting were: Highway Superintendent Melvin Peterson, Lakewood Busti Chief of Police John Bentley, Mathew Barron, Mike Sanfilippo, Ray Ayers, Susan Lane, Joyce Roof, Charles Roof, Stan Davis, Marilyn Riotto, Michael Looker, Emiley Johnsonb, Mary Miller, Kathleen Anderson, John Francisco, Cindy Hagberg, and EJ McCague.
Susan Lane, Village Historian, thanked the town for keeping the Bentley Cemetery mowed and trimmed so well . Supervisor Jesse Robbins noted Jack Knowlton is the caretaker for the town cemeteries.
Several in attendance inquired about what amount would be budgeted in the 2017 budget to fund the Lakewood Library. Supervisor Robbins noted there will be a public hearing on October 17th at which time the 2017 budget will be discussed.
Kathleen Anderson, Lakewood Library board member, noted she spoke with the Post Journal regarding the Question of the Day which asked if residents were in favor of raising taxes to increase funding to the Lakewood Library and the Post Journal stated there was no way to identify where those that responded actually reside.
Chief John Bentley reported 8,020 incidents YTD. The Canine Unit will be in Syracuse tomorrow for mandatory training. The department held a “truck detail” in response to several complaints, there were 68 summonses issued over a 4 hour period.
Highway Superintendent Melvin Peterson reported the department continues to mow the roadsides and will be blacktopping Park Meadow Drive at the end of this week. Last week the department worked half staffed due to vacation, jury duty, and family leave.
Supervisor Robbins noted the following bids had been received for the specific projects:
- Exterior painting and patching at the Town of Busti Town Administration building, 125 Chautauqua Avenue, Lakewood, New York.
– Swan Painting, Inc – $11,900.00
– T.M. Desmond Construction LLC – $32,994.00
Councilman Todd Hanson moved the following resolution which was duly seconded by Councilman Jim Andrews:
RESOLVED, the Town of Busti Town Board award the bid to Swan Painting, Inc in the amount of $11,800.00 for exterior painting and patching at the Town Administration Building, 125 Chautauqua Avenue, Lakewood, New York. Swan Painting, Inc. should supply a certificate of insurance to the town prior to starting the project.
Upon roll call vote, all aye, carried.
The Highway Department will be removing the old “boiler room” prior to Swan Painting, Inc. beginning the project.
- New HVAC equipment, controls, and installation at the Town of Busti Town Administration building, 125 Chautauqua Avenue, Lakewood, New York.
– Citadel Services, Inc. – $86,888.00
– King’s Heating & Cooling – $23,700.00
– Jamestown Heating & Air Systems – $20,800.00
Councilman Todd Hanson moved the following resolution which was duly seconded by Supervisor Jesse Robbins:
RESOLVED, the Town of Busti Town Board award the bid to Jamestown Heating & Air Systems in the amount of $20,800.00 for new HVAC equipment, controls, and installation at the Town Administration Building, 125 Chautauqua Avenue, Lakewood, New York. Jamestown Heating & Air Systems should supply a certificate of insurance to the town prior to starting the project.
Upon roll call vote, all aye, carried.
- Spray foam insulation at the Town of Busti Town Administration building, 125 Chautauqua Avenue, Lakewood, New York.
– United Thermal Systems – $12,080.00
– Sanfilippo Solutions – R49 Option – $69,067.20
R28 Option – $55,867.20
Councilman Hanson moved the following resolution, which was duly seconded by Councilman Andrews:
RESOLVED, the Town of Busti Town Board award the bid to United Thermal Systems in the amount of $12,080.00 for spray foam insulation at the Town Administration Building, 125 Chautauqua Avenue, Lakewood, New York. United Thermal Systems should supply a certificate of insurance to the town prior to starting the project.
Upon roll call vote, all aye, carried.
The Cold Storage area needs to be cleaned out before United Thermal Systems can begin the project. Supervisor Robbins will contact Josh Pike and request that all boats are removed as soon as possible.
- Shingle removal; removal of plywood down to the existing purlin; and installation of new tin roof, including insulation and all proper trim work for the Town of Busti Highway Cold Storage building located at 3646 Lawson Road, Jamestown, New York.
– Empire Development – $41,446.00 (labor only)
Supervisor Robbins moved the following resolution, which was duly seconded by Councilman Hanson:
RESOLVED, the Town of Busti Town Board rebid the above project with a specified project completion date of July 1, 2016 and to allow the contractor to include materials and labor in their bid, however the bid should show a breakdown for each. The bid opening will be December 2, 2016 at noon at the Administration Office, 125 Chautauqua Ave., Lakewood, NY.
Upon roll call vote, all aye, carried.
Highway Superintendent Peterson noted he spoke with National Grid regarding installing another street light on Cramar Drive, as requested by Chautauqua Metal Finishing Supply. National Grid will send documentation to the town to sign. The subject is tabled until the documentation has been received.
Supervisor Robbins moved to set a public hearing on the 17th day of October, 2016, at 7:00 p.m. regarding the adoption of Local Law No. 3 of 2016 entitled “A Local Law to Override the Tax Levy Limit Established in General Municipal Law 3-C.” Motion was duly seconded by Councilman Hanson.
The proposed local law would permit the Town Board of the Town of Busti to adopt a budget for the fiscal year of 2017 with a real property tax levy in excess of the limit specified in General Municipal Law Section 3-C.

Supervisor Robbins moved to set a public hearing on the 17th day of October, 2016 at 7:15 p.m. on the 2017 Preliminary Budget which was duly seconded by Councilman Hanson:

Supervisor Robbins noted that he and Village of Lakewood former Mayor Wordleman had recognized a need of an asbestos inspector, at a cost that was less than what was currently being charged by other inspectors. They agreed to have the Code Enforcement Officer trained and begin inspecting. A fee schedule was approved and it was agreed that the town, village, and CEO would equally split the fees collected minus any expense. The first payment was received last month in the amount of $1,075 each.
Supervisor Robbins moved the following resolution which was duly seconded by Councilman Andrews:
RESOLVED, Court Clerk Elizabeth Davis be authorized to apply for the JCAP grant.

Supervisor Robbins moved to authorized the Town Clerk and Bookkeeper to attend the Civil Service Training Seminar in Mayville, NY on Thursday, October 27th at 1:00 p.m. – 3:30 p.m., which duly seconded by Councilman Hanson.

Supervisor Robbins moved the following resolution which was duly seconded by Councilman Hanson:
RESOLVED, Supervisor Robbins be authorized the NOVA Intercept Contract.

Supervisor Robbins moved the following resolution which was duly seconded by Councilman Hanson:
RESOLVED, that Supervisor Robbins be authorized and directed to pay the presented General Fund, Highway Fund, and the Joint Recreation Fund for Abstract No. 16 from warrant #606 to and including warrant #642 in the amount of $99,568.55.
Upon roll call vote, all aye, carried.
Supervisor Robbins moved to accept the September 19, 2016 town board minutes, which was duly seconded by Councilman Lawton.

Supervisor Robbins motioned to adjourn the meeting at 7:15 p.m., which was duly seconded by Councilman Andrews.
