Also present: Richard L. Peebles-Architect, Bruce Carlson, Kevin DiLuca, Jean Macey, Michael Macey, Joe Siperek, Robert & Laura Roush, Janet & Brian Carlson, and Code Enforcement Officer Jeffery Swanson.

A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, June 22, 2016 at 7:00 p.m. at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following application:

Application of Janet Carlson, 250 Lister Avenue, Falconer, New York, for an area variance to construct a garage and a covered porch addition.  Property is located at 685 Creek Road, Jamestown, New York, owned by her and known as Section 437.00, Block 1, Lot 25 of the official tax map of the Town of Busti.  Property is in the Conservation/Agricultural District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood.  Gary Starr made a motion to grant the application of Janet Carlson to construct a garage and covered porch addition with the condition that the existing house be inspected by a design professional and deemed as a safe structure. The garage will be 11’x20’ and the covered porch will be 11’x34 and located no closer than 14’ from the road.  Seconded by Tim Young.  All aye.  Carried.

Application of Adam Padd, 4402 West Fairmount Avenue, Lakewood, New York for an area variance for a storage shed.  Property is owned by him and known as Section 385.05, Block 4, Lot 9 of the official tax map of the Town of Busti.  Property is in the Conservation/Residential District. Mr. Padd was not present. Gary Starr made a motion to deny the application of Adam Padd to build a storage shed due to the fact that there is not a primary residence on the property, according to Town of Busti Zoning Code §405-12 D; motion was seconded by Kathy Stedman. All aye. Carried.

Application of Robert T. Roush, 2165 Fifth Avenue, Lakewood, New York for an area variance to construct a garage.  Property is owned by him and known as Section 384.12, Block 1, Lot 37 of the official tax map of the Town of Busti.  Property is in the Conservation/Residential District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Gary Starr made a motion to grant the application of Robert T. Roush to construct a garage. The variance is required due to the rear setback. The garage will be 36’X40’ with a 14’X40’ open lean-to and will be located no closer than 20’ from the west (rear) boundary. Motion was seconded by Tim Young. All aye. Carried

Application of Richard L. Peebles Architect, 20 Barker Street, Fredonia, New York for an area variance to construct a garage.  Property is owned by Loomis Bay Shores, LLC, located at 35 Loomis Bay Road, Ashville, New York, and known as Section 367.15, Block 2, Lot 12 of the official tax map of the Town of Busti.  Property is in the Multi-Family Residential District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Tim Young made a motion to grant the application of Richard L. Peebles to construct a garage. The variance is required due to the lot size; the front, side, and rear set backs; and maximum lot coverage. The garage will be 23’x24’ and be located no closer than 5’ from the south boundary (drainage area in the rear), no closer than 10’ to the north boundary (road), no closer than 11.8’ to the east boundary and no closer than 5’ to the west boundary. Motion was seconded by Gary Starr. All aye. Carried

Upon motion made by Tim Young and seconded by Kathy Stedman, the meeting was adjourned at 8:21 p.m.
