A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, September 28, 2016 at 7:00 p.m. at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following applications:

Application of Cynthia A. Reiss, 1007 Hunt Road, Lakewood, New York to renew a special use permit to operate an existing insurance office. Property is owned by her and is known as Section 385.03, Block 2, Lot 14 of the official tax map of the Town of Busti.  Property is in the Conservation/Residential District.  Douglas Hooper made a motion to grant the application of Cynthia Reiss to renew a special use permit to operate an existing insurance office.  The renewal is for a three year term.  Seconded by Richard Nygren.  All aye.  Carried.

Application of James Lindstrom, 33 Loomis Bay Road, Ashville, New York for an area variance to construct a garage.  Property is owned by Loomis Bay Shores, LLC, located at 33 Loomis Bay Road, Ashville, New York, and known as Section 367.15, Block 2, Lot 14 of the official tax map of the Town of Busti.  Property is in the Multi-Family Residential District. Richard Nygren made a motion to grant the application of James Lindstrom for an area variance to construct a 24’ x 24’ 1 ½  story garage.  The garage is to be no closer than 10’ to either side property boundary, no closer than 14’ to the north boundary, and  no closer than 7.5’ to the south boundary. The existing two sheds that are currently on the property are  to be removed.  Seconded by Gary Starr.  All aye.  Carried.

Application of Joshua Kell, 1748 Forest Avenue Extension, Jamestown, New York for an area variance to construct a garage.  Property is owned by him and known as Section 404.01, Block 2, Lot 8 of the official tax map of the Town of Busti.  Property is in the Conservation/Residential District. Douglas Hooper made a motion to grant that application of Joshua Kell for an area variance to construct a garage.  Variance is for 10’ relief of the required 250’ road frontage.  Seconded by Tim Young.  All aye.  Carried.

Application of Barbara Bergman, 997 Wellman Road, Ashville,  New York for an area variance to construct a metal storage building.  Property is owned by her and known as Section 418.00, Block 2, Lot 13 of the official tax map of the Town of Busti.  Property is in the Conservation/Agricultural District.  Tim Young made a motion to grant the application of Barbara Bergman for an area variance to construct a 24’ x 40’ one story metal storage building.  Variance is required due to insufficient lot size.  Seconded by Richard Nygren.  All aye.  Carried.

Upon motion made by Tim Young, the meeting was adjourned at 7:27 p.m.
