REGULAR MEETING
November 7, 2016
A regular meeting of the Town Board of the Town of Busti was held on Monday, November 7, 2016 at 6:45 p.m., at the Town of Busti, Town Administration Building, 125 Chautauqua Avenue, Lakewood, New York with the following members present:

Supervisor Robbins called the meeting to order with the salute to the flag and a moment of silence was observed.
Present at the meeting were: Highway Superintendent Melvin Peterson, Chief John Bentley, Attorney Joel Seachrist, Adam Glasier – Post Journal, Barb & John Silo, Jean & Jerry Holmes, Judy Schultz, Duane Anderson, Pat Linder, Michelle P. McIntyre, Ray Ayers, Douglas Conroe, Mary Miller, Michael Looker, John Francisco, Myra Blasius, Kathleen Anderson, Mary McCague, EJ McCague, Sandra Kearney, Wendy Kane, David Bargar, Lisa Peterson, Karen Dennerlein, and Ray Tudor.
Douglas Conroe, Chautauqua Lake Association Executive Director, noted he was concerned with the Town of Busti annual contribution to the CLA. In 2007 the town contributed $10,000 to the association, which continued through 2012. The contribution in 2013 was reduced to $2,000 and has remained there through 2016. Mr. Conroe noted the association receives many calls of concern each year from the South Basin which is the Vukote area. He gave each board member a copy of the 2016 CLA Lake Maintenance Summary and pointed out there were 6,920 ton of Aquatic Vegetation removed from the lake in 2016. The Chautauqua Lake Association would appreciate it if the town board would consider increasing the town’s contribution in 2017.
Myra Blasius, Lakewood Memorial Library President, requested there be no change to the $58,000 contribution to the library that was approved at the last town board meeting.
Judy Schultz stated she thought it was time to cut the budget. She feels the town should support the Highway Department, Police Departments, and local Fire Departments.
Chief of Police John Bentley reported 8,900 incidents year to date. He noted the department continues to have a number of burglaries reported and encouraged residents to keep their homes and cars locked, and report any suspicious activity.
Highway Superintendent Melvin Peterson reported the highway department has finished all blacktopping. The blacktop plant will be closing in a week and a half. The department has been working on trucks, preparing for the winter weather and is all set with a supply of rock salt through the first of the year. The vault door for the “records room” will be delivered within the next few weeks.
Councilman Mueller distributed a packet with his 2017 Budget amendment proposals and supporting information. Supervisor Robbins also presented a sheet with his proposals for revisions to the 2017 budget. Discussion followed.
The following resolutions are all amendments to the 2017 Preliminary Budget:
- Councilman Mueller moved the following resolution, which was duly moved by Councilman Hanson:
RESOLVED, to increase “Transfers to Other Funds”, A9901.900 from $46,500 to $58,000, which increases the funding to Hazeltine Library.

- Councilman Mueller moved the following resolution, which was duly moved by Councilman Lawton:
RESOLVED, to increased “Interfund Transfer”, L 5031, from $46,500 to $58,000.

- Councilman Lawton moved the following resolution, which was duly moved by Councilman Hanson:
RESOLVED, to increase “Home and Community Services Environ Control – Contractual”, A8090.400, form $7,000 to $11,000. The $4,000 increase will be additional funding to Chautauqua Lake Association.

- Councilman Mueller moved the following resolution, which was duly moved by Councilman Lawton:
RESOLVED, to increase “Transportation, Supt. of Highways-Personal Services”, A5010.100, from $70,693 to $72,193.

- Councilman Mueller moved the following resolution, which was duly moved by Councilman Lawton:
RESOLVED, to decrease “Hospital & Medical Insurance”, A 9060.800, from $83,200 to $74,700 and DB9060.800 from $67,200 to $52,200.
Upon roll call vote, all aye, carried.
- Supervisor Robbins moved the following resolution, moved to return 2017 Sales Tax Revenue B1120 and DB1120 to $360,000 each. There was no second on the motion.
- Councilman Mueller moved the following resolution, which was duly moved by Councilman Lawton:
RESOLVED, to decrease “Transportation General Repairs – Personal Services”, DB5110.100 by $10,000 and increase “Machinery – Equipment” DB5130.200 by $10,000.
Upon roll call vote, all aye, carried.
- Councilman Mueller moved the following resolution, which was duly moved by Councilman Lawton:
RESOLVED, to increase “Transportation Maintenance of Bridges – Capital Outlay” DA5120.200 from $5,000 to $20,000. The $20,000 will be from Unexpended Fund Balance. Also, to decrease “Transportation General Repairs – Personal Services”, DB5110.100, an additional $5,000 bringing the budget amount to $163,747.

- Councilman Mueller moved the following resolution, which was duly moved by Councilman Hanson:
RESOLVED, to increase revenue in “Sale of Property – Equipment Sale”, DB2665, to $77,500; which includes $32,500 from the sale of the 2005 International Truck, $25,000 from the sale of the Highway Superintendent’s truck, and $20,000 from the sale of the excavator.

- Councilman Mueller moved the following resolution, which was duly moved by Councilman Hanson:
RESOLVED, to increase “Machinery – Equipment”, DB5130.200, from $20,000 to $160,000: using $77,500 from DB2265; $15,000 from DB5110.100; $15,000 from DB9060.800; $15,000; $22,500 from fund balance; and $10,000 from DB1120.

- Councilman Hanson moved the following resolution, which was duly moved by Councilman Andrews:
RESOLVED, to include $13,500 from County of Chautauqua Industrial Development Agency Pilots in “Real Property Tax Items – Other Payments in Lieu”, A1081; “Real Property Taxes”, A1001, will be $646,989.

- Supervisor Robbins moved the following resolution, which was duly moved by Councilman Hanson:
RESOLVED, to increase “Culture and Recreation Parks – Equipment”, A7110.200 from $15,000 to $25,000.

Councilman Lawton moved the following resolution, which was duly moved by Councilman Hanson:
RESOLVED, to adopt Local Law No. 3 of 2016 entitled “A LOCAL LAW TO OVERRIDE THE TAX LEVY EZTABLISHED IN GERNERAL MUNICIPAL LAW SECTION 3-C”. It is the intent of this local law to override the limit on the amount of real property taxes that may be levied by the Town of Busti, County of Chautauqua, pursuant to General Municipal Law § 3-C, and to allow the Town of Busti, County of Chautauqua, to adopt a town budget for (a) town purposes (b) fire protection districts and (c) any other special or improvement district governed by the town board for the fiscal year 2017 that requires a real property tax levy in excess of the “tax levy limit” as defined by General Municipal Law § 3-C.

Highway Superintendent Peterson stated one bid had been received for the purchase of the 2005 International 7600 truck with a 14’ painted stainless steel box and 119,115 miles. The bid was from Signature Paving and Sealing: 1. $32,500 for the truck with the plow and wing 2. $28,500 for the truck alone.
Councilman Hanson moved the following resolution, which was duly moved by Councilman Mueller:
RESOLVED, to accept the bid from Signature Paving and Sealing, in the amount of $32,500, to purchase the 2005 International 7600 truck with the stainless steel box and the plow and wing.

Councilman Hanson moved the following resolution, which was duly moved by Councilman Lawton:
RESOLVED, to authorize Town Clerk Nygren to apply for the Local Government Records Management Improvement Fund Grant through New York State Archives. The grant application is due January 17, 2017.

Councilman Hanson moved the following resolution, which was duly moved by Councilman Mueller:
Resolution Authorizing Town of Busti to enter into an agreement with the New York State Thruway Authority to sell E-ZPass Tags.
WHEREAS, Town of Busti Clerk’s Office or any other approved municipal location wishes to retail E-ZPass Tags through the New York State Thruway Authority’s E-ZPass On-the-Go Program;
WHEREAS, Town of Busti Clerk’s Office or any other approved municipal location will purchase E-ZPass tags for the cost of $21.00 per Tag from the Thruway Authority and sell the Tags at a cost of $25.00 per tag, allowing the Town of Busti to keep $4.00 per sale, and
THEREFORE BE IT RESOLVED, that the Town Board of the Town of Busti hereby authorizes the Town of Busti Clerk’s office or any other approved municipal location to enter in an agreement with the New York State Thruway Authority to sell E-ZPass Tags provided all legal requirements are complied with.

Supervisor Robbins moved the following resolution, which was duly moved by Councilman Hanson:
RESOLVED, to accept the revisions to the 2017 Preliminary Budget and adopt the 2017 Final Budget.

Councilman Hanson moved the following resolution which was duly moved by Councilman Lawton:
RESOLVED, that Supervisor Robbins be authorized and directed to pay the presented General Fund, Highway Fund, and the Joint Recreation Fund for Abstract No. 18 from warrant #671 to and including warrant #725 in the amount of $104,401.90.
Upon roll call vote, all aye, carried.
Councilman Lawton moved to accept the October 17, 2016 town board minutes, which was duly moved by Supervisor Robbins.

Councilman Hanson motioned to adjourn the meeting at 10:35 p.m., which was duly moved by Councilman Lawton.
