A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, October 26, 2016 at 7:00 p.m. at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following applications:
Application of Cole Smith, Jamestown, New York for an area variance to construct a sun room addition. Property is owned by Larry Ensign, located at 1464 Trask Road, Jamestown, New York, and known as Section 403.00, Block 2, Lot 34 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Doug Hooper made a motion to grant the application of Cole Smith to construct a sunroom addition to an existing home located at 1464 Trask Road, Jamestown, New York, and owned by Larry Ensign. Sunroom will be built on a foundation and will measure 25’ by 11’. An area variance is granted due to lot size being less than two acres. Seconded by Richard Nygren. All aye. Carried.
Application of Matthew T. Pavlock, 1303 Forest Avenue Extension, Jamestown, New York for an area variance to construct a garage on property owned by him, located at 1289 Forest Avenue Extension, Jamestown, New York and known as Section 421.00, Block 1, Lot 44 of the official tax map of the Town of Busti. Property is in the Conservation/ Agricultural District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Richard Nygren made a motion to grant the application of Matthew T. Pavlock to construct a pole barn-style garage measuring 40’ x 32’ with a 40’ x 12’ lean-to on one side. The building is to be no closer than 24’ to either side property boundary. Seconded by Douglas Hooper. All aye. Carried.
Application of David and Elizabeth Trusel, 3430 Lawson Road, Jamestown, New York for an area variance to install roof solar panels. Property is owned by them and known as Section 437.06, Block 2, Lot 17 of the official tax map of the Town of Busti. Property is in the Highway Commercial District. Mr. Trusel was in attendance. It came to the Board’s attention that in addition to the proposed solar panel project, a front porch of approximately 12’ x 8’ had recently been built on the property without a building permit and for which an area variance would be required due to it not meeting the required front yard setback of 50’. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Tim Young made a motion to grant an area variance to David and Elizabeth Trusel to install solar roof panels, with variance due to property being less than one acre, and to build a front porch. Porch is to be no closer than 20’ to the road (front property boundary). Mr. and Mrs. Trusel are to provide specs/drawings of the porch to the Code Enforcement Officer and obtain a building permit. Seconded by Gary Starr. All aye. Carried.
Upon motion made by Tim Young, the meeting was adjourned at 7:20 p.m.
