A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, May 24, 2017 at 7:00 p.m. at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following applications:
Application of Michael Johnson, Jamestown, New York, for a Special Use Permit to operate an antique shop on Southwestern Drive, Jamestown, NY. The property is owned by Robert A. Schultz and known as Section 420.00 Block 2 Lot 34 of the official tax map of the Town of Busti. Property is in the Conservation/Agricultural District. Mr. Johnson was in attendance and described his plans for the business. Gary Starr made a motion to grant the application of Michael Johnson for a Special Use Permit to operate an antique store. The existing sign will be used. The majority of merchandise will be inside and will not be left out overnight. If the second floor is to be used, it must be inspected for code. Seconded by Kathy Stedman. All aye. Carried.
Application of Robert Sprankle, 917 Hunt Rd., Lakewood, New York for a variance to build an addition. Property is in the Conservation/Residential District, owned by him and known as Section 385.04, Block 1, Lot 66 of the official tax map of the Town of Busti. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Kathy Stedman made a motion to grant the application of Robert Sprankle for a 50’ lot width variance to build an addition. Seconded by Gary Starr. All aye. Carried.
Application of Gary Meutsch, Hamburg, New York for an area variance for an enclosed porch addition on property located at 2405 Lakeside Drive, Ashville, New York. Property is owned by him and known as Section 367.20, Block 3, Lot 40 of the official tax map of the Town of Busti. Property is in the Multi-Family Residential District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Tim Young made a motion to grant the application of Gary Meutsch for an enclosed porch addition. Variance is granted for 1.8 acres for lot area, 55’ for lot width, and 37’ for the rear yard dimension. Seconded by Scott Schang. All aye. Carried.
Application of Carl and Dawn Calimeri, Jamestown, NY for an area variance to construct a garage on property located at 4410 Fairmount Avenue, Lakewood, New York. Property is owned by him and known as Section 385.05, Block 4, Lot 6 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Scott Schang made a motion to grant the application of Carl and Dawn Calimeri to construct a garage. Variance is granted for .058 acres for lot area, 70’ for lot width, 25’ on the front yard dimension, 11’ 4” on the west side yard dimension, and 1’2” on the east side yard dimension. Water flow from the gutters and downspouts will be directed onto owner’s property. Seconded by Tim Young. All aye. Carried.
Application of John Bremmer, 2012 Winch Road, Lakewood, New York for an area variance to construct a garage. Property is owned by him and known as Section 385.03, Block 2, Lot 36 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood Tim Young made a motion to grant the application of John Bremmer for 24’ x 24’ garage, to be no closer than 22’ to the south side property boundary. Variance is granted for .91’ for lot width and 18’ on the south side yard. Seconded by Gary Starr. All aye. Carried.
Upon motion made by Tim Young, the meeting was adjourned at 7:51 p.m.
