A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, July26, 2017 at 7:00 p.m. at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following applications:
Application of Ronald W. Kohl, 3923 Farview Lane (Shadyside Road), Lakewood, New York for an area variance for a fence. Property is owned by him and known as Section 402.00, Block 2, Lots 70 and 74 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Tim Young motioned to grant the application of Ronald Kohl for an 8’ high fence, approximately 180’ long and 5’ from the property line. Seconded by Kathy Stedman. All aye. Carried.
Application of Brian Conklin, 1875 Shadyside Road, Lakewood, New York, for an area variance to rebuild and expand an existing garage. Property is owned by him and known as Section 402.00, Block 2, Lot 69 of the official tax map of the Town of Busti. Property is in the Conservation Residential District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Scott Schang made a motion to grant the application of Brian Conklin to rebuild and expand the existing garage. Variance is granted for 30’ on the front yard dimension and a 20’ on the side yard dimension. Seconded by Kathy Stedman. All aye. Carried.
Application of Terence and Heidi Couchenour, 800 Hunt Road, Lakewood, New York for an area variance for a shed. Property is owned by them and known as Section 385.04, Block 1, Lot 31 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Kathy Stedman motioned to grant the application of Terence and Heidi Couchenour for a 26’ x 12’ pre-fabricated shed. Variance is granted for lot size, lot width and a west side yard variance of 25.5’. Seconded by Tim Young. All aye. Carried.
Application of Jeff Swanson, 132 Creek Road, Jamestown, New York for a variance for a shed and a garage addition. Property is in the Conservation/Agricultural District, owned by him and known as Section 454.00, Block 1, Lot 17 of the official tax map of the Town of Busti. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Tim Young motioned to grant the application of Jeffrey Swanson for a 12’ x 14’ shed, to be no closer than 27’ from the front property boundary and 12’ from the south property boundary, and for a 32’ x 40’ garage addition. A lot width variance of 64’ is granted for both the shed and garage addition. Seconded by Scott Schang. All aye. Carried.
Application of John McKnight, Springville, New York for an area variance for a shed on property located at 2401 Lakeside Drive, Ashville, New York. Property is owned by him and known as Section 367.20, Block 3, Lots 41.2 and 43 of the official tax map of the Town of Busti. Property is in the Multi-Family Residential District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Scott Schang made a motion to grant the application of John McKnight for an 8’ x 10’ shed. Variance is granted for lot area, lot width, 2.5’ on the northwest side yard and 40’ on the rear yard. The shed shall be no closer than 12.5’ to the northwest side property boundary and no closer than 10’ to the canal (rear property boundary). Seconded by Kathy Stedman. All aye. Carried.
Application of Michael Boardman, 904 Southwestern Drive, Jamestown, New York for an area variance to repair and extend a porch. Property is owned by him and known as Section 420.19, Block 1, Lot 38 of the official tax map of the Town of Busti. Property is in the Highway Commercial District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Kathy Stedman motioned to grant the application of Michael Boardman to repair and extend an existing porch. Variance is granted for lot size and 28’ on the front yard. The porch will be no closer than 21’ 10” to the front property boundary. Seconded by Tim Young. All aye. Carried.
Upon motion made by Tim Young, the meeting was adjourned at 7:35 p.m.
