A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, June 28, 2017 at 7:00 p.m. at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following applications:
Application of Paul A. Burger, 1093 South Main Street Ext., Jamestown, New York for an area variance for a shed. Property is owned by him and known as Section 421.00, Block 2, Lot 33 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Gary Starr made a motion to grant the application of Paul Burger for a 12’ x 16’ storage shed. Variance is granted for lot size of one acre, 10’ on the north side property boundary, and 32’ on the rear property boundary. Seconded by Tim Young. All aye. Carried.
Application of Richard DeVlieger, 1600 Shadyside Road, Lakewood, New York for an area variance for a shed. Property is owned by him and known as Section 402.00, Block 3, Lots 27 and 28 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Tim Young made a motion to grant the application of Richard DeVlieger for a 24’ x 24’ shed. Variance is granted for 50’ lot width and 20’ on the north side property boundary. Seconded by Scott Schang. All aye. Carried.
Application of Ryan Seekings, 308 Creek Road, Jamestown, New York for a variance to build a garage. Property is in the Conservation/Agricultural District, owned by him and known as Section 454.00, Block 1, Lot 4 of the official tax map of the Town of Busti. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Scott Schang made a motion to grant the application of Ryan Seekings to build a 32’ x 48’ garage. Variance is granted for a 20’ setback on the north side property boundary versus the required 40’ setback. Seconded by Gary Starr. All aye. Carried.
Application of Jake Ensign, 1464 Trask Road, Jamestown, New York for an area variance to construct a pole barn. Property is owned by him and known as Section 403.00, Block 2, Lot 34 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. Mr. Ron Lindstrom addressed the Board regarding his concern about the proximity of the proposed barn to his property. Based on Mr. Lindstrom’s concerns, Mr. Ensign agreed to place the pole barn on the west side of his property instead of the east side as submitted in his application, and to place it a greater distance from his rear property boundary. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Tim Young made a motion to grant the application of Jake Ensign for a 30’ x 50’ pole barn. The barn will be no closer than 30’ to the west side property boundary, granting a variance of 10’, and no closer than 30’ to the rear property boundary, granting a variance of 20’. Seconded by Gary Starr. All aye. Carried.
Upon motion made by Tim Young, the meeting was adjourned at 7:45 p.m.
