REGULAR MEETING
October 2, 2017
A regular meeting of the Town Board of the Town of Busti was held on Monday, October 2, 2017 at 6:45 p.m., at the Town of Busti, Town Administration Building, 125 Chautauqua Avenue, Lakewood, New York with the following members present:

Supervisor Robbins called the meeting to order with the salute to the flag and a moment of silence was observed, Supervisor Robbins asked those present to remember those affected by the Las Vegas tragedy.
Present at the meeting were: Highway Superintendent Melvin Peterson, Busti Lakewood Police Chief John Bentley, Attorney Joel Seachrist, Bob and Judy Schultz, Ray Ayers, Busti Fire Department Chief Matt Stafford, Jeremy Hasson, Lakewood Memorial Library Trustee President Mary McCague and Trustee Karen Peterson Dennerlein.
Judy Schultz, on behalf of the Busti Historical Society, thanked the Lakewood Busti Police Department and the Town of Busti Board Members for their support at the Apple Festival, September 24th.
Town Clerk Darlene Nygren reported the Doe Management Assistant Program tags have arrived for the upcoming hunting season. A public notice has been submitted to the Post Journal. Land owners in the designated area should see the Town Clerk to obtain up to three tags. Clerk Nygren noted the Golden Ager Aerobic class will no longer be meeting at Lakewood Baptist Church and will not need liability insurance coverage from the Town of Busti. The new location does not have steps and will be more conducive for participants. Tina Sardo, instructor, has requested to have the option open to return to Lakewood Baptist under the name of the Town of Busti if this move does not work out.
Chief John Bentley reported the department has had 7,412 incidents ytd and 343 incidents since the last board meeting. Chief Bentley reminded residents to keep their doors locked as burglaries have been on the rise and to notify the police department immediately of any suspicious activity. Chief Bentley noted the Canine Unit assisted the Jamestown Police Department with a drug raid locating an automatic weapon. The “Body Cameras” have been working well and reduce the number of complaints against officers. The department should hear from the county soon about the radio upgrade, the current phones will be traded in when the upgrade takes place.
Highway Superintendent Melvin Peterson reported the department continues to work on Creek Road replacing the pipe, the paving should be done tomorrow and the guardrail installed on Friday. Lawson Road will be paved if there are funds available from this year’s budget. Plow frame material has been ordered for the new truck. Superintendent Peterson noted he received an estimate of $12,500 to repave the front parking lot at 125 Chautauqua Avenue.
Chief Matt Stafford reported the Busti Fire Department has had 270 incidents ytd. He noted approximately 30 pagers will have to be purchased to synchronize with the police radio upgrades, the department is looking for ways to help defer the cost. The department assisted with the Apple Festival parking and set up.
Supervisor Robbins noted construction has begun on the Loomis Park Concession stand and is progressing well.
The board reviewed and discussed the proposals to purchase or rent a new postage machine/meter. Pitney Bowes, Hagan Business, Lineage, and Usherwood Office Technology all submitted proposals.
Councilman Hanson moved the following resolution which was duly moved by Councilman Mueller:
RESOLVED, the Town of Busti accept the proposal from Lineage to purchase a Neopost IN-700 Automatic Digital Mailing System with Color Touch Screen & Mixed Mail Feeder, 10lb Integrated Digital Weigh Platform, Envelope Sealer, and Catch Tray at the cost of $4,737.75 for equipment & software; Monthly Meter Rental & iMeter Apps – $35; Annual Maintenance Agreement – $684.00; and no cost for Annual Subscription Services.
Upon roll call vote, all aye, carried.
Supervisor Robbins moved to set a public hearing on the 16th day of October, 2017, at 7:00 p.m. regarding the adoption of Local Law No. 2 of 2017 entitled “A Local Law Permitting Agribusinesses and Agritourism Businesses by Special Use Permit in the Conservation Residential (CR) and Conservation Agriculture (CA) Districts and Swimming Pools in the Highway Commercial District”. Motion was duly seconded by Councilman Hanson.

Supervisor Robbins noted Extreme Marine is interested in renting the Cold Storage space again this winter for boat and vehicle storage. Last year there was an issue with mildew. Jamestown Heating and Air suggested installing an Air Exchange at an approximate cost of $1,800 – $2,000. Discussion followed. It was decided to turn the heat on low and on a timer, which should be less costly.
The board discussed the 2018 Tentative Budget. Items discussed included the DB fund balance, the need to construct a Records Room, contract for the Lakewood Busti Police Department, Councilmen and Supervisor salaries, as well as sales tax revenue. The board asked for clarification of the Contingency account A1990.400 – $20,000; Equipment & Capital Outlay account A1620.200 – $16,600; and the amount of refund that will be received due to canceling the Asbestos Liability Insurance policy.
Councilman Mueller moved the following resolution, which was duly moved by Councilman Lawton:
RESOLVED, to adjust the amount budgeted in account A1010.100 from $24,000 to $22,000 which will be a 0% increase from 2017 budget.
Upon roll call vote, all aye, carried.
Councilman Mueller moved the following resolution, which was duly moved by Councilman Hanson:
RESOLVED, to adjust the amount budgeted in account A1220.100 from $18,000 to $16,000 which will be a 33.33% increase from the 2017 budget.
Upon roll call vote, all aye, carried.
Representatives from Lakewood Memorial Library asked the board to consider raising the budgeted funding to the library from $58,000 to $69.500, as requested. The reason for the increase request is to prepare for the upcoming 259 Initiative proposal, the library has lost funding, in recent years, from both the town and village, the increase would carry the library through 2018 with a flat budget for 2019. The 259 Initiative could be passed as early as May 2018.
Councilman Lawton moved the following resolution, which was duly moved by Councilman Mueller:
RESOLVED, to increase the amount budgeted in account A7410.400 from $58,000 to $69,500 for 2018 only and to support the 259 Initiative option, with the understanding that if the 259 proposal fails the amount of future funding to the Lakewood Memorial Library cannot be guaranteed. The increase in funding will be 19.82% from the 2017 budget.

Supervisor Robbins moved to set a public hearing on the 16th day of October, 2017, at 7:15 p.m. regarding the Preliminary 2018 Budget. Motion was duly seconded by Councilman Hanson.
Upon roll call vote, all aye, carried.
Supervisor Robbins moved the following resolution which was duly moved by Councilman Hanson:
RESOLVED, that Supervisor Robbins be authorized and directed to pay the presented General Fund, Highway Fund, and the Joint Recreation Fund for Abstract No. 14 from warrant #587 to and including warrant #625 in the amount of $46,209.84.
Upon roll call vote, all aye, carried.
Supervisor Robbins moved to accept the September 18, 2017 Town Board minutes as presented, motion was duly moved by Councilman Mueller.
All in favor, carried.
Supervisor Robbins motioned to adjourn the meeting at 9:37 p.m., which was duly moved by Councilman Andrews.
