REGULAR MEETING
December 18, 2017
A regular meeting of the Town Board of the Town of Busti was held on Monday, December 18, 2017 at 6:45 p.m., at the Town of Busti, Town Administration Building, 125 Chautauqua Avenue, Lakewood, New York with the following members present:

Councilman Jim Andrews
Councilman Todd Hanson
Councilman Kenneth Lawton
Councilman Rudy Mueller
Supervisor Robbins called the meeting to order with the salute to the flag and a moment of silence was observed.
Present at the meeting were: Highway Superintendent Melvin Peterson, Busti Lakewood Police Chief John Bentley, Busti Fire Department Chief Matt Stafford, Chautauqua County Legislator P.J. Wendell, and Ray Ayers.
Town Clerk Darlene Nygren reported 2018 County Town tax bills are being printed by the county and the first day to collect will be January 8, 2018. Clerk Nygren reported the NEO Post postage machine was installed on Friday, December 15th. The town received a refund check from Pitney Bowes, postage reserve account, in the amount of $4,615.30. The cost of the new machine was $4,637.75. Additional unused funds uploaded in the meter will be refunded from Pitney Bowes.
Chief John Bentley reported the department has had 9,075 incidents ytd and 298 incidents since the last board meeting. The canine unit assisted Jamestown Police Department in locating a suspect’s gun after an arrest.
Highway Superintendent Melvin Peterson reported the department was out plowing over the weekend. The new truck is working well. The department is building a new wing for one of the trucks, which saves the department approximately $500 as compared to purchasing one.
Busti Fire Department Chief reported the department had a total of 329 incidents ytd; in the past two weeks there have been 11 EMS calls, 1 motor vehicle accident, and 2 fires. The department recently held there election: Matt Stafford will remain Chief, Dave Crandall – 1st Assistant Chief, Troy Carlson – 2nd Assistant Chief, and Steven McKinsey – 3rd Assistant Chief. The department recently purchased a new generator and is waiting for the installation to be completed.
Highway Superintendent Peterson noted the Highway Department had capped the wall blocks on the new concession stand, Councilman Hanson contacted Ryan White regarding the Loomis Park Concession Stand and a timetable for completion. Mr. White was going to contact the contractors and get back to Councilman Hanson.
Highway Superintendent Peterson reported he had received a purchase price for the new Superintendent truck, Chevy Extended Cab LX at $31, 277, under the state bid. The Kelly Blue Book price for the current Superintendent truck is $21,800. Both transactions were included in the 2017 budget. Discussion followed.
Councilman Mueller moved the following resolution, which was duly moved by Councilman Hanson:
RESOLVED, to accept the state bid of $31,277 to purchase the 2018 Chevrolet Silverado 1500 4WD Double Cab LT truck and sell the 2015 Chevrolet Silverado 1500 Double Cab LT truck to the Parks Department for $25,000.
Upon roll call vote, all aye, carried.
Highway Superintendent spoke with the State Comptroller’s office regarding the unused funds in “Roads”. They recommended making a budget amendment as opposed to setting up a Reserve Account.
Supervisor Robbins moved the Town Board send a letter to the Village of Lakewood Trustee Board regarding any interest the Village has regarding to officially negotiate a consolidation of administration office and police department locations. Motion was duly moved by Councilman Andrews.
All in favor, carried.
Supervisor Robbins moved the Town Board submit a letter to NYS Compensation Board noting the town is opting out of the Paid Family Leave Benefit and a copy sent to Shelter Point. Motion was duly moved by Councilman Lawton.

Supervisor Robbins moved the Town Board set the date for the 2018 Organization Meeting on January 8, 2018 at 6:45 p.m. Motion was duly moved by Councilman Lawton.
All in favor, carried.
Supervisor Robbins moved the following resolution, which was duly moved by Councilman Hanson:
RESOLVED, to execute interfund transfers from the General Fund (A) to the Bentley Cemetery (TE1) in the amount of $5,363.43; from the General Fund (A) to the Busti Cemetery (TE2) in the amount of $2,241.94; and from the General Fund (A) to the Wellman Cemetery Fund (TE3) in the amount of $2,027.56. These amounts have been included in the General Fund budget. By definition, interfund transfers are transfers intended to subsidize the receiving of funds and will not be repaid.
Upon roll call vote, all aye, carried.
Supervisor Robbins moved the following resolution which was duly moved by Councilman Hanson:
RESOLVED, that Supervisor Robbins be authorized and directed to pay the presented General Fund, Highway Fund, and the Joint Recreation Fund for Abstract No. 18 from warrant #763 to and including warrant #790 in the amount of $118,618.54.
Upon roll call vote, all aye, carried.
Supervisor Robbins moved to accept the December 4, 2017 Town Board minutes as presented, motion was duly moved by Councilman Mueller.
All in favor, carried.
Councilman Andrews noted there will be a Public Scoping meeting on December 28th at 7:30 p.m. at the Fluvanna Fire Department, regarding the proposed Chautauqua Lake Herbicide Treatment.
Discussion followed. Legislator P.J. Wendell noted the county is in the process of establishing an advisory board which would consist of 2 Legislators whose districts involve lake property, 2 Supervisors/Mayors whose municipality has lake access, and 2 residents from the Chautauqua Lake area.
All board members were encouraged to review the proposed 2018 appointments, employee benefits, policies, and agreements as outlined in the organizational document.
Supervisor Robbins motioned to adjourn the meeting 7:46 p.m., which was duly moved by Councilman Lawton.
