Also present: Robert T. Roush, Laura J. Roush, Melanie Howard, Debra Morlock, Bob Kuhn, and Darcy Kuhn.

 

A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, February 28, 2018 at 7:00 p.m. at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following application:

 

Application of Debora L. Morlock, 4354 West Summit, Lakewood, New York, for an area variance for an addition.   Property is owned by her and known as Section 385.05, Block 4, Lot 28 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood.  Scott Schang motioned to grant the application of Debra L. Morlock to construct a 16’ x 12’ addition on the west of the existing house. The addition will be 2 feet narrower than the house. The following variances were granted: Minimum lot area – .15 acres; minimum lot width – 75 feet; and minimum side yard dimensions – 5.8 feet on the east side and 11.6 feet on the west side. Motion seconded by Kathy Stedman, all aye, carried.

 

Application of Robert Kuhn, McKees Rocks, Pennsylvania for an area variance to enlarge a porch on property owned by him, located at 2418 Keller Road, Ashville, New York and known as Section 367.20, Block 2, Lot 56 of the official tax map of the Town of Busti.  Property is in the Multi-Family Residential District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood.  Tim Young motioned to grant the application of Robert Kuhn to replace an existing porch with a 6’ x 8’ porch with a second story deck and a roof over the upper deck. The porch is located on the west side of the existing house. The following variances were granted: Minimum lot area – ¼ acre and minimum lot width – 50 feet. Motion was seconded by Scott Schang, all aye, carried.

 

Application of Melanie Howard, 4746 Ashville Road, Ashville, New York for an area variance to construct a garage.  Property is owned by her and known as Section 384.11, Block 2, Lot 1 of the official tax map of the Town of Busti.  Property is in the Conservation/Residential District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood.  Doug Hooper motioned to grant the application of Melanie Howard to replace an existing 12’ x 20’ garage with a 30’ x 40’ two car garage, the new garage will be one story and a metal pole building. The following variances were granted: Minimum lot width – 130 feet and minimum side yard dimensions – 32 feet on the westside. Motion was seconded by Tim Young, all aye, carried.

 

Application of Robert T. Roush, 2165 Fifth Avenue, Lakewood, New York for an area variance to construct a garage.  Property is owned by him and known as Section 384.12, Block 1, Lot 37 of the official tax map of the Town of Busti.  Property is in the Conservation/Residential District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood.  Tim Young motioned to grant the application of Robert T. Roush to construct a one-story pole type garage. The following variances were granted: Minimum lot area – .825 acres; minimum side yard; minimum side yard – 22 feet on the northside; and minimum rear side – 14 feet on the westside. Motion was seconded by Scott Schang, all aye, carried.

 

Upon motion made by Tim Young and seconded by Scott Schang, the meeting was adjourned at 7:25pm.
