A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, April 25, 2018 at 7:00 p.m. at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following applications:
Application of Michael Cessna, 1451 Big Tree Road, Lakewood, New York, for a renewal of a special use permit for a golf driving range located on Big Tree Road, Lakewood, New York. Property is in the Conservation/Residential District, owned by him and known as Section 401.00, Block 3, Lot 9 of the official tax map of the Town of Busti. Scott Schang made a motion to approve the application of Michael Cessna for a renewal of his special use permit to operate a golf driving range business at 1451 Big Tree Road, Lakewood, New York. Seconded by Doug Hooper. All aye. Carried.
Application of Family Church of the Southern Tier, 3130 Garfield Road, Jamestown, New York, for a renewal of a special use permit for a church. Property is in the Conservation/Residential District, owned by them and known as Section 403.08, Block 2, Lot 49 of the official tax map of the Town of Busti. Tim Young made a motion to approve the application of Family Church of the Southern Tier for a renewal of a special use permit to operate a church at 3130 Garfield Road, Jamestown, New York. Seconded by Scott Schang. All aye. Carried.
Application of Joshua and Amy Pike, Lakewood, New York, for renewal of a special use permit to operate a boat storage and service business on 4736 Cramer Drive, Ashville, New York. Property is in the Light Manufacturing/Research and Development District, owned by them, and known as Section 401.00, Block 2, Lot 3.1 of the official tax map of the Town of Busti. Doug Hooper made a motion to approve the application of Josh and Amy Pike for a renewal of a special use permit to operate a boat storage and service business at 4736 Cramer Drive, Ashville, New York. Seconded by Gary Starr. All aye. Carried.
Application of Nicklas Sherman, 1451 Winch Road, Lakewood, New York, for an area variance to construct a garage on said property. Property is owned by him, known as Section 402.00, Block 3, Lot 59 of the official tax map of the Town of Busti and is in the Conservation Residential District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Gary Starr made a motion to grant the application of Nicklas Sherman for a 40’ x 40’ garage on said property. The garage will be for personal use and will be no closer than 45’ to the south side yard property boundary. Variance is granted for lot width. Seconded by Tim Young. All aye. Carried.
Application of Wilson Corah, Orchard Park, New York for an area variance to construct a garage and front porch roof on property owned by him, located at 2461 Lakeside Drive, Ashville, New York and known as Section 367.20, Block 3, Lot 13 of the official tax map of the Town of Busti. Property is in the Multi-Family Residential District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Scott Schang made a motion to grant the application of Wilson Corah to construct a garage, covered patio and front porch roof. The existing garage will be demolished. Variance is granted for 24,700 square feet for lot area, 78.5’ for lot width and approximately 10% over maximum lot coverage. For the garage and covered patio, a front yard variance of 6’ is granted, a south side yard variance of 6’6” is granted at the front of the garage, 10’ at the back of the garage, and 11’9” for the patio. The patio will be built to extend no closer to the canal than the existing house, which is 42.5’. The garage dimension is 24’ x 32’and the covered patio is 10’ x 14’ and is not to be enclosed. For the 6’ x 6’front porch roof, variance is granted for 6’ on the north side yard boundary. Seconded by Gary Starr. All aye. Carried.
Application of Matt and Aleesha Stafford, 3181 Burton Road, Jamestown, New York for an area variance for a deck addition. Property is in the Conservation/Agricultural District, owned by them and known as Section 454.00, Block 2, Lot 8 of the official tax map of the Town of Busti. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Tim Young made a motion to grant the application of Matt and Aleesha Stafford for a rear deck addition and front porch addition. The deck will be 8’ wide and run the length of the house. The front porch will be 10’ x 36’ with a 12’ roof. Variance is granted for lot size and for 26’ on the rear property boundary.
Application of Daniel Keefe, 4440 Chautauqua Boulevard, Lakewood, New York for an area variance for a pool. Property is in the Highway Commercial District, owned by him and known as Section 385.05, Block 3, Lot 27 of the official tax map of the Town of Busti. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Doug Hooper made a motion to grant the application of Daniel Keefe to install a 15’ above-ground pool. The pool is to be no closer than 8’ to the north property boundary, granting a variance of 17’, and will be equipped with all safety requirements. Seconded by Gary Starr. All aye. Carried.
Upon motion made by Tim Young, the meeting was adjourned at 7:47pm.
