A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, May 23, 2018 at 7:00 p.m. at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following applications:
Application of James Francisco, 889 Busti Sugar Grove Road, Jamestown, New York for an area variance for an addition to an existing garage. Property is in the Highway Commercial District, owned by him and known as Section 420.18, Block 1, Lot 17 of the official tax map of the Town of Busti. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Gary Starr made a motion to grant the application of John Francisco for a 72’ x 50’ addition to the existing garage. The garage is to be no closer than 2’ to the rear property boundary. Seconded by Scott Schang. All aye. Carried.
Application of Dennis Kramer, Boston, New York for an area variance to construct a garage on property owned by him and Thomas Kramer, located at 94 Goose Creek Road, Ashville, New York and known as Section 367.15, Block 2, Lot 77 of the official tax map of the Town of Busti. Mr. Kramer was in attendance and discussed the proposed plans for the garage. The Board had several questions concerning the property boundaries and the road right-of-way and determined that clarification from Town of Busti attorney Joel Seachrist was needed before a decision could be made on Mr. Kramer’s variance request. Tim Young motioned to table the application of Dennis Kramer for an area variance to construct a garage at 94 Goose Creek Road until the next scheduled public hearing before the Zoning Board of Appeals, which is tentatively scheduled for Wednesday, June 27, 2018 at 7:00 p.m. Seconded by Gary Starr. All aye. Carried.
Application of Michael Cessna, Lakewood, New York, for an area variance for an addition and porch alteration on property located at 3777 Baker Street Extension, Lakewood, New York. Property is in the Conservation/Residential District, owned by him and known as Section 402.00, Block 2, Lot 36 of the official tax map of the Town of Busti. Mr. Cessna was in attendance and informed the Board that the existing room off the back of the house is going to remain as is and not be altered into a porch. The Board noted that a variance would therefore not be needed for that portion of the application but would still be required for his proposed addition. Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Doug Hooper made a motion to grant the application of Michael Cessna for an 8’ x 24’ addition, which will connect the house and garage. Variance is granted for 1.5 acres for lot size and 150’ for lot width. Seconded by Tim Young. All aye. Carried.
Application of David Gniewecki, 4379 West Summit Street, Lakewood, New York for an area variance for a deck. Property is in the Conservation/Residential District, owned by him and known as Section 385.05, Block 4, Lot 75 of the official tax map of the Town of Busti. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Tim Young made a motion to grant the application of David Gniewecki for a 12’ x 12’ deck. A rear yard setback variance of 40’is granted, so the deck is to be no closer than 10’ to the rear yard property boundary. Variance is also granted for 0.077 acre lot size and 4.43’ lot width. Seconded by Tim Young. All aye. Carried.
Upon motion made by Tim Young, the meeting was adjourned at 7:55pm.
