REGULAR MEETING
July 16, 2018
A regular meeting of the Town Board of the Town of Busti was held on Monday, July 16, 2018 at 6:45 p.m., at the Town of Busti, Town Administration Building, 125 Chautauqua Avenue, Lakewood, New York with the following members present:

Supervisor Robbins called the meeting to order with the salute to the flag and a moment of silence was observed.
Present at the meeting were: Highway Superintendent Melvin Peterson, Busti Lakewood Police Chief John Bentley, Busti Fire Dept Chief Matt Stafford, Ray Ayers, Erin Brickley, and Pat Fincher
Chief John Bentley reported the department has had 4,895 incidents ytd and 736 incidents since the last board meeting.
Busti Fire Chief Matt Stafford reported the following incidents for the past month: 11 EMS, 8 fire/fire related and 6 motor vehicle calls. The year to date total is 177 calls.
Highway Superintendent Melvin Peterson reported the highway department has finished blacktopping Lawson Rd. and is working on Wellman Rd. from Baker St. to Sandstrom Rd. Stone/oil is scheduled to start in early August. The water line hook-up work for the Loomis concession building has been pushed back.
Superintendent Peterson also reported that he received a trade-in offer from Five Star and requested permission to trade in the 2013 John Deere 624 Loader valued at $123,300 for a new 2018 John Deere 624 Loader priced at $163,300, for an after-trade-in cost of $40,000.
Councilman Mueller moved the following motion which was duly seconded by Councilman Hanson:
RESOLVED, that upon the recommendation of Highway Superintendent Melvin J. Peterson, he be authorized to purchase a new John Deere 624 Loader for a net cost of $40,000 after the trade in of the 2013 John Deere Loader.
Upon roll call vote, all aye.
Supervisor Robbins moved the following resolution which was duly seconded by Councilman Hanson:
RESOLVED, the Town Board approve the following budget amendment:
Increase A7110.400 (Parks Contractual) Expenditure and A2680 (Insurance Proceeds) Revenue in the amount of $530.00 for insurance payment for towing of the Parks truck.
Upon roll call vote, all aye, carried.
Erin Brickley, Executive Director of the Chautauqua Lake and Watershed Management Alliance appeared before the Board and presented drawings and data for the proposed Lakewood & Busti storm water swales project. She noted the grant application is due at the end of July, with the grant award announcement expected in December 2018.
Councilman Mueller moved the following resolution which was duly seconded by Councilman Hanson:

Resolution to Participate in Efforts to Fund the Lakewood & Busti Precision Swale Retrofits Project
WHEREAS, Chautauqua Lake is an invaluable asset to Chautauqua County but has been designated as an impaired water body and its health and usability are threatened; and
WHEREAS, Chautauqua Lake currently has a Total Maximum Daily Load for phosphorus of 0.02 mg/l, which favorably positions the Town and Village for grant-funded water quality improvement projects; and
WHEREAS, New York State (NYS) Consolidated Funding Application (CFA) offers state-wide grant funding programs that provide an opportunity to significantly leverage local resources; however, these grant programs are fiercely competitive and require a local match in cash and/or in-kind services; and
WHEREAS, the 2018 CFAs includes the NYS Department of Environmental Conservation (DEC) Water Quality Improvement Project Program (WQIP), which offers state grant funding for water quality related projects and which requires local match; and
WHEREAS, the Chautauqua County Department of Planning and Economic Development (PED), the Chautauqua Lake and Watershed Management Alliance (Alliance), the Village of Lakewood, and the Town of Busti have successfully partnered to procure previous state funding in 2016 which has now delivered an engineering study which identifies meaningful stormwater projects located within the Village and Town that can now be pursued for implementation funding that will have a positive impact on the environmental health of Chautauqua Lake; and
WHEREAS, the Town of Busti in partnership with the Village of Lakewood, County PED and Alliance, have identified the Lakewood & Busti Precision Swale Retrofits project for application to the 2018 WQIP grant program which provides reimbursement for up to 75% of total project costs; and

WHEREAS, the Chautauqua Lake & Watershed Management Alliance (Alliance) has been established as a nonprofit New York organization to collaborate and coordinate amongst its Members to procure funding for projects recommended in the Chautauqua Lake Watershed Management Plan, the Macrophyte Management Strategy, and the Chautauqua Lake Local Waterfront Revitalization Program via grant writing, to benefit the water quality of Chautauqua Lake on behalf of its Members; and
WHEREAS, the Village, the Town and the County are Members of the Alliance; therefore be it
RESOLVED, that the Town of Busti will act as the primary grant applicant and that the Town of Busti shall commit to providing in-kind services for operation and maintenance and traffic control valued at $34,587.00 as well as $5,000.00 cash toward required local match.

Supervisor Robbins opened discussion on the Hazeltine Library payroll processing. Pat Fincher, representing Hazeltine Library, stated that aside from their funding now coming from the school with the passage of the 259 referendum, no other changes are occurring. The library is requesting the Town of Busti continue to process the payroll for library employees, with Hazeltine then reimbursing the Town.
Supervisor Robbins moved the following resolution which was duly seconded by Councilman Andrews:
RESOLVED, that the Town of Busti will continue to process the payroll for Hazeltine Library, with Hazeltine using the funding received from the school to reimburse the Town.

Supervisor Robbins moved the following resolution which was duly seconded by Councilman Hanson:
RESOLVED, that Supervisor Robbins be authorized and directed to pay the presented General Fund, Highway Fund, and the Joint Recreation Fund for Abstract No. 9 from warrant #393 to and including warrant #454 in the amount of $91,247.93.
Upon roll call vote, all aye, carried.
Supervisor Robbins moved to accept the June 18, 2018 Regular Town Board minutes, motion was duly moved.

Councilman Andrews reported he received a call from a resident of Lakeside Drive in Ashville who said the lake is the clearest it’s been in the past 10 years and who wished to thank the Town for their participation in the herbicide application.
Supervisor Robbins moved to adjourn the meeting at 7:30 p.m. which was duly moved by Councilman Hanson.
