REGULAR MEETING
June 18, 2018
A regular meeting of the Town Board of the Town of Busti was held on Monday, June 18, 2018 at 6:45 p.m., at the Town of Busti, Town Administration Building, 125 Chautauqua Avenue, Lakewood, New York with the following members present:
Supervisor Jesse M. Robbins
Councilman Jim Andrews
Councilman Todd Hanson
Councilman Kenneth Lawton
Councilman Rudy Mueller
Supervisor Robbins called the meeting to order with the salute to the flag and a moment of silence was observed.
Present at the meeting were: Highway Superintendent Melvin Peterson, Busti Lakewood Police Chief John Bentley, Code Enforcement Officer Jeff Swanson, Busti Fire Dept Chief Matt Stafford, Tore Arvidson, Cathy Koebelin, Jim Mahoney, Shelby Kalfas, and Winston Frankson.
Cathy Koeblin thanked the board for proceeding with the Chautauqua Lake Herbicide Treatment; her family has owned property on the lake for 30 + years and have watched the (weeds) condition of the lake deteriorate over the years. Ms. Koeblin stated there were other neighboring property owners, not able to attend tonight’s meeting, that appreciate the town acting to address the weed issue.
Councilman Lawton thanked Ms. Koeblin for taking the time to personally thank the board. He noted there is always a need for volunteers and with financial support with the local lake organizations.
Shelby Kalfas stated she would like to volunteer her time to do clean-up work in the Town of Busti cemeteries. The board referred her to the town Cemetery Sexton, Jack Knowlton.
Tore Arvidson noted he had received a notice from Code Enforcement Officer Swanson regarding the building and property at 3344 Baker Street Extension, owned by him. The notice stated the building is in non-compliance because it is an accessory building without a residence. Mr. Swanson noted the Town of Busti Zoning Code does not allow an accessory building without a residence. Discussion followed. Supervisor Robbins will consult with the town attorney regarding the matter.
Town Clerk Darlene Nygren reported her office began selling2018-19 transfer stickers Monday, June 11th. Clerk Nygren received “Notice of Proposed Premium Rate Change” from Univera Healthcare. The proposed premium rate changes for Univera Access Standard Gold is -0.7% and for Univera Access Gold 2 is -0.8%. Final rate information will be received at least 60 days before the 2019 renewal date.
Chief John Bentley reported the department has had 4,160 incidents ytd and 320 incidents since the last board meeting.
Highway Superintendent Melvin Peterson reported on his recent attendance at Highway School. The highway department will be blacktopping the following roads: Anderson, Paternitti, Holly, Lawson from Big Tree Rd to Wellman Rd, Keller – rebuilding a catch basin and then resurfacing. The department assisted the county with milling on Summit Avenue and will be assisting the Village of Lakewood on Oak Street. The department will receive millings from both projects. Most of the highway department will be on vacation the week of the 4th of July.
Code Enforcement Officer reported there were two applications received for the Fire Inspector position.
Busti Fire Chief reported the following incidents for the month of May: 22 – EMS; 8 – Fire/Fire Alarms; 1 – MVA for a total of 31 and for the month of June: 6 – EMS; 1 – Fire/Fire Alarm; 1 – MVA for a total of 8. The year to date total is 150 calls.
Winston Frankson inquired why the Highway Department stopped repairing Garfield Road at the top of the hill. Highway Superintendent Peterson noted the roller broke down and is now being repaired. The work on Garfield Road will continue when the roller is operable.
Supervisor Robbins moved the following resolution which was duly moved by Councilman Andrews:
RESOLVED, the Town Board approve the following budget amendment:
Transfer $1,002.00 from A1110.400 – Justice Contractual to A1110.200 – Justice Equipment for 6 file cabinets and court chair ganging.
Upon roll call vote, all aye, carried.
Supervisor Robbins moved the following resolution which was duly moved by Councilman Hanson:
RESOLVED, to authorize Court Clerk Elizabeth Davis to attend Court Clerk conference, September 16 – 19, 2018 in Lake Placid, NY.

Supervisor Robbins moved the following resolution which was duly moved by Councilman Mueller:
RESOLVED, that Supervisor Robbins be authorized and directed to pay the presented General Fund, Highway Fund, and the Joint Recreation Fund for Abstract No. 8 from warrant #351 to and including warrant #392 in the amount of $128,434.51.
Upon roll call vote, all aye, carried.
Supervisor Robbins moved to accept the June 4, 2018 town board meeting minutes which was duly moved by Councilman Mueller.
All in favor, carried.
Councilman Mueller noted he would like to continue conversation regarding the town and village consolidating their administration buildings. Councilman Hanson stated a letter has been sent to the Village Trustees regarding the matter and the offer of discussion remains open.
Councilman Andrews reported Chautauqua Lake and Watershed Alliance received the final DEC report on the Lakewood/Busti Stormwater Study. The three proposed projects are Lowe Stormwater Park, Chautauqua Avenue Green Street Retrofit, and Village& Town Stormwater Swales.
Councilman Hanson reported Solar Liberty is preparing the final contracts. He has been communicating with National Grid on the Streetlight conversion, there are a couple more forms that need to be completed. The Loomis Park concession stand construction is continuing; the cupboards are installed, the counter top will be installed next week, the electric is complete. The concession facility is now usable. The water and sewer will be a project for the fall, once complete the restrooms will be functioning.
Councilman Lawton stated he was disappointed that the Village of Lakewood Mayor is questioning the location of where the herbicides were applied in Chautauqua Lake. The DEC had approved the location of the herbicide application. Councilman Lawton reported the county did agree to sponsor the grant application of the bike trail from Celeron to Lakewood on Summit Avenue, it would be an 80/20 share grant. The grant application will be a third time applying for the bike trail and he is hoping that the state will take that in to consideration.
Supervisor Robbins noted that due to the 4th of July holiday, the next Town Board meeting is scheduled for Monday, July 16th.
Supervisor Robbins moved to adjourn the meeting at 7:24 p.m. which was duly moved by Councilman Hanson.
