A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, October 24, 2018 at 7:00 p.m. at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following applications:
Tim Young moved to open the meeting to revisit and amend the application that was previously done on June 27, 2018 for Thomas Myers (original applicant was Jerry Leighton, acting on behalf of Mr. Myers) for a variance to construct a new single-family home at 19 Loomis Bay Road, Ashville, New York. Property is in the Multi-Family Residential District, owned by him and known as Section 367.15, Block 2, Lot 28 of the official tax map of the Town of Busti. Mr. Myers was in attendance and explained that the original building was 44 feet from structure to the lake on the easternmost property line, and this measurement was shown on the original print. However, due to the contour of the lake, the original structure measured 37.5 feet from structure to the lake on the westernmost property line, and this measurement was not shown on the original print. As such, the 40 foot setback from the lake granted in the original motion could not be met on the westernmost side of the property. Gary Starr made a motion to make an amendment to the original variance to have the structure 37.5 feet from the lake, and with the deck added, to be no closer than the original footprint of the previous deck. Seconded by Tim Young. All aye.
Revisiting the application, which was tabled at the previous September 26, 2018 meeting, of Elizabeth Kaltenbach, 4678 Ashville Road, Ashville, New York for an area variance to install a pool and deck. Property is owned by her and Kenneth Kaltenbach and known as Section 384.11, Block 2, Lot 15 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. Ms. Kaltenbach was in attendance and stated that she has not obtained a property survey. It was determined by the Board that, since the pool and deck are already in place, they would need to know the exact property boundaries and the setback of the pool and deck before a determination could be made. Tim Young made a motion to table the application Elizabeth Kaltenbach until the next Zoning Board of Appeals meeting scheduled for November 28, 2018. Seconded by Gary Starr. All aye. Carried.
Upon motion made by Tim Young, the meeting was adjourned at 7:45pm.
