REGULAR MEETING
November 19, 2018
A regular meeting of the Town Board of the Town of Busti was held on Monday, November 19, 2018 at 6:45 p.m., at the Town of Busti, Town Administration Building, 125 Chautauqua Avenue, Lakewood, New York with the following members present:
Supervisor Jesse M. Robbins
Councilman Jim Andrews
Councilman Rudy Mueller
Absent: Councilman Todd Hanson
Councilman Kenneth Lawton
Supervisor Robbins called the meeting to order with the salute to the flag and a moment of silence was observed.
Present at the meeting were: Jack Knowlton and Susan Lane.
Jack Knowlton expressed his concern of having graveside burial ceremonies during the winter months at the Busti Cemetery. He stated the ground in the cemetery is so soft and the driveways are very narrow, there is a risk of someone either getting their vehicle stuck or tripping over a gravestone. Mr. Knowlton would like the boards approval to allow him to determine if such burial should take place inside the gate along the roadside.
Supervisor Robbins moved to give Jack Knowlton, Busti Cemetery Sexton, the authority to determine the location of a burial ceremony, during the winter months, at Busti Cemetery; motion was duly moved by Councilman Andrews.

Clerk Darlene Nygren reported she is preparing to send the 2019 Town Budget to the Chautauqua County Real Property Tax Department. Clerk Nygren noted the town received a legal notice regarding a public hearing for a Special Use Permit to allow Dipson Theatres to sell and serve alcohol beverages. Clerk Nygren stated Court Clerk Elizabeth Davis has requested to be authorized to attend an informational session relative to the new state mandated Judges Centralized Arraignment Program. There is a $10 fee for the session. The new program will require all arraignments to take place at a centralized location and each judge in the county municipalities will be required to oversee the arraignments for a week or two on a rotating basis. The judges will receive payment for their specific assignment.
Supervisor Robbins moved the following resolution, which was duly moved by Councilman Mueller:
RESOLVED, Court Clerk Elizabeth Davis be authorized to attend the CAP informational session at JCC on Wednesday, November 28th or Saturday, December 15th at a cost of $10 and to pay Ms. Davis over time if need be.
Upon roll call vote, all aye, carried.
Clerk Nygren noted she was informed Highway employee, Josh Pilling, was not reimbursed for electing to not have health insurance coverage in 2017. The reimbursement would be paid retroactive and would include the months of September through December.
Supervisor Robbins moved the following resolution, which was duly moved by Councilman Mueller:
RESOLVED, the Town of Busti reimburse Josh Pilling for electing to not have health insurance coverage in 2017. The reimbursement would be retroactive, including the months of September through December.
Upon roll call vote, all aye, carried.
Supervisor Robbins moved to set the following public hearings be held by the Town Board of the Town of Busti, motion was duly moved by Councilman Mueller:
Public Hearing pursuant to Article 405.19 Highway Commercial District-B of the Zoning Code on the following: The application of Gene Swanson of 108 Oakland Avenue, Lakewood, New York, for a Special Use Permit to operate a general automotive repair shop in the Highway Commercial District. The property is located at 4471 Chautauqua Boulevard, Lakewood, New York. Said property is known as Section 385.05, Block 5, and Lot 7 of the official tax map of the Town of Busti.
Said hearing will take place on December 3, 2018 at 7:00 p.m.
Public Hearing pursuant to Article 91-470-HC-2 and Article 91-600 of the Zoning Code
of the Town of Busti on the following renewal proposition: The application of Tom Carlson, 3350 Busti-Stillwater Road to renew a Special Use Permit to lease existing building for auto sales and repair station. The Property is located at 3343 Busti Stillwater Road, Jamestown, New York and is owned by him and known as Section 437.07 Block 1 Lot 21.2 of the official tax map of the Town of Busti.
Said hearing will take place on Monday, December 3, 2018 at 7:05 p.m.
Public Hearing regarding the adoption of Local Law No. 4 of 2018 entitled “A Local Law Enacting Regulations For Solar Energy Systems.”, the said hearing will be held at 7:15 p.m. on December 3, 2018.
The proposed local law would adopt regulations and a permitting process for the installation of solar energy systems. Small-scale systems would be permitted in all districts. Large-scale systems would be permitted in the Industrial, Conservation-Agricultural, and CAMP Districts subject to special use permit issued by the Town Board.

Supervisor Robbins noted the town had received notification from NYS Dept of Transportation regarding their intent to approve the speed limit reduction on Sandstrom Road. It will be the town’s responsibility to install the new speed limit signs.
Supervisor Robbins noted Chautauqua Lake and Watershed Management Alliance has recommended that the Town of Busti be eligible for RFA grant funding in the amount of $10,000 through Sheldon Foundation and Chautauqua Regional Community Foundation.
Councilman Andrews noted there is $300,000 available for the grant funding and the Alliance received applications requesting over $1,000,000. The Alliance is recommending $40,000 be designated towards herbicide treatment on Chautauqua Lake, which would be divided evenly amongst the towns of Busti, Ellery, Ellicott, and North Harmony. The applications were reviewed by an outside source, a science committee, and Alliance employees. County Executive George Borrello had recommended $80,000 be funded for the herbicide treatment but the amount was reduced $40,000.
Supervisor Robbins moved the following resolution, which was duly moved by Councilman Andrews:
RESOLVED, that Mary Eggleston be reappointed to the Board of Assessment Review for the term of 10/01/2018 through 09/30/2023.
Upon roll call vote, all aye, carried.
Supervisor Robbins moved the following resolution which was duly seconded by Councilman Andrews:
RESOLVED, that Supervisor Robbins be authorized and directed to pay the presented General Fund, Highway Fund, and the Joint Recreation Fund for Abstract No. 16 from warrant #708 to and including warrant #744 in the amount of $41,531.21.
Upon roll call vote, all aye, carried.
Supervisor Robbins moved to accept the November 5, 2018 Regular Town Board minutes, motion was duly moved by Councilman Mueller.

Supervisor Robbins moved to adjourn the meeting at 7:04 p.m. which was duly moved by Councilman Andrews.
