A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, August 22, 2018 at 7:00 p.m. at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following applications:

Application of Brian Orlando, 5 Edgewood Drive, Lakewood, New York, for an area variance for a shed. Property is owned by him and known as Section 385.03, Block 1, Lot 23 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Tim Young made a motion to grant the application of Brian Orlando for a 16’ x 10’ shed. A variance of 48’ is granted on the east side property boundary, so the shed can remain in its current location as long as the paper street adjoining his property remains undeveloped. Seconded by Doug Hooper. All aye. Carried.

Application of David Goris, Grand Island, New York, for an area variance to construct a garage on property located at 17 Loomis Bay Road, Ashville, New York. Property is owned by him and known as Section 367.15, Block 2, Lot 30 of the official tax map of the Town of Busti. Property is in the Multi-Family Residential District. Mr. Goris was in attendance and explained that two garage plans were submitted, as he has not made a final decision on the size. The garage width on both plans is 14’, but the length will either be 47’ or 38’. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Douglas Hooper made a motion to grant the application of David Goris for a garage. For either plan, the garage is to be no closer than 5’ to the west side yard property boundary, and no closer than 12’ to the east side boundary. If the larger garage is built, it is to be no closer than 45’ to the edge of the road. Seconded by Tim Young. All aye. Carried.

Application of Bill Burk, 2475 Lakeside Drive, Ashville, New York, for an area variance to build a deck over an existing porch roof. Property is owned by him and known as Section 367.20, Block 3, Lots 9 and 10 of the official tax map of the Town of Busti. Property is in the Multi-Family Residential District. The deck has been partially constructed, and a neighbor in attendance expressed concern about the appearance and safety of the structure. Discussion followed, and the Board determined that additional information from Code Enforcement Officer Jeff Swanson regarding the deck design was needed before a decision could be made on Mr. Burk’s variance request. Scott Schang made a motion to table the application of Bill Burk until the next Zoning Board of Appeals meeting on September 26, 2018. Seconded by Tim Young. All aye. Carried.

Upon motion made by Tim Young, the meeting was adjourned at 7:35pm.
