A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, June 27, 2018 at 7:00 p.m. at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following applications:
Application of Shirley Ecker, 1945 Hoag Road, Ashville, New York for an area variance to build a roof over an existing porch. Property is in the Conservation/Residential District, owned by her and known as Section 384.18, Block 1, Lot 37 of the official tax map of the Town of Busti. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Douglas Hooper made a motion to grant the application of Shirley Ecker to add a roof over her existing porch. Variance is granted for a half acre on lot size and for 92’ on the lot width. Seconded by Kathy Stedman. All aye. Carried.
Application of Jerry Leighton, Stow, New York, for an area variance to construct a single-family home on property located at 19 Loomis Bay Road, Ashville, New York. Property is owned by Thomas Myers, Gettysburg, Pennsylvania, and known as Section 367.15, Block 2, Lot 28 of the official tax map of the Town of Busti. Property is in the Multi-Family Residential District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Scott Schang made a motion to grant the application of Jerry Leighton to construct a two story, single-family house. The house is to be no closer than 5’ to either side yard property boundary, no closer than 40’ to the lake, and no closer than 12’ to the front (road side) property boundary. Variance is also granted for lot width (125’ required, property has 33.75’), lot size (1/2 acre required, property has approx. 4300 square feet), and lot coverage (maximum is 25%, property will be approx. 39%). House will have gutters and downspouts for proper drainage. Seconded by Gary Starr. All aye. Carried.
Application of Randall Jay Delahoy, 4342 Nutt Road, Jamestown, New York for a special use permit for a camp on said property. Property is in the Conservation Agricultural District, owned by him and is known as Section 419.00, Block 2, Lot 51 of the official tax map of the Town of Busti. Kathy Stedman made a motion to grant the application of Randall Jay Delahoy for a camp at 4342 Nutt Road. The permit allows Mr. Delahoy’s camper plus six additional campers, to be in use for the holiday season running from Memorial Day plus 100 days, with the proper septic/sewage facilities set up, checked weekly. Mr. Delahoy is to contact the Chautauqua County Health Department to ensure he is compliant with County regulations.
Revisiting the application of Dennis Kramer, which was tabled at the previous zoning board meeting of May 23, 2018, for an area variance to construct a garage on property located at 94 Goose Creek Road. Property is owned by him and Thomas Kramer and known as Section 367.15, Block 2, Lot 77 of the official tax map of the Town of Busti. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Scott Schang made a motion to grant the application of Dennis Kramer to construct a garage. A variance of 22,500 square feet is granted for lot size, 47’ for lot width, and 10% for lot coverage. For the front property boundary, a variance is granted to build at the line between the highway right-of-way and his property, and for the rear property boundary, a variance of 45’ is granted. A variance is also granted for the existing shed to be moved and placed no closer than 5’ to any property boundary. Seconded by Kathy Stedman. All aye. Carried.
Upon motion made by Tim Young, the meeting was adjourned at 7:55pm.
