A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, March 27, 2019 at 7:00 p.m. at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following applications:
Application of Andrew Bowen, Jamestown, New York, for an area variance for a roof alteration at 4357 West Summit Street, Lakewood, New York. Property is owned by Lawrence Nall and known as Section 385.05, Block 4, Lot 60 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Doug Hooper made a motion to grant the application of Andrew Bowen for a roof alteration on an existing building, with no change to the building footprint. Variance is granted for lot area and lot width. Seconded by Tim Young. All aye. Carried.
Application of John and Nancy Reynolds, West Seneca, New York, for an area variance for a second story addition on property located at 2458 ½ Lakeside Drive, Ashville, New York. Property is owned by them and known as Section 367.20, Block 4, Lot 22 of the official tax map of the Town of Busti. Property is in the Multi-Family Residential District. The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Scott Schang made a motion to grant the application of John and Nancy Reynolds for a second story addition. Variance is for side yard setback, which will not change from the existing building. Seconded by Tim Young. All aye. Carried.
Revisiting the application, which was tabled at the previous November 28, 2018 meeting, of Elizabeth Kaltenbach, 4678 Ashville Road, Ashville, New York for an area variance to install a pool and deck. Property is owned by her and Kenneth Kaltenbach and known as Section 384.11, Block 2, Lot 15 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Tim Young made a motion to grant the application of Elizabeth Kaltenbach for a pool and deck, to be no closer than 15’ to rear property boundary. The pool and deck which is already in place is required to be moved to meet the 15’ setback. Seconded by Scott Schang. All aye. Carried.
Upon motion made by Scott Schang, the meeting was adjourned at 7:24 pm.
