A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, May 22, 2019 at 7:00 p.m. at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following applications:
Application of Gary Meutsch, Hamburg, New York for an area variance for an addition to an existing home at 2405 Lakeside Drive, Ashville, New York. Property is owned by him and known as Section 367.20, Block 3, Lots 40 and 41.1 of the official tax map of the Town of Busti. Property is in the Multi-Family Residential District. The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Scott Schang made a motion to grant the application of Gary Meutsch for an addition to the existing house. Variance is granted for 22,525 square feet for lot area, 45’ for lot width, and on the canal side, the addition is to be no closer than 14’6” to the canal. Seconded by Gary Starr. All aye. Carried.
Application of Ronald Hicks, Ashville, New York, for an area variance for a single family home on property located at 2 Loomis Lane, Ashville, New York. Property is owned by Scorse-Loomis Bay Properties, LLC and known as Section 327.15, Block 2, Lot 48..S001 of the official tax map of the Town of Busti. Property is in the Multi-Family Residential District. The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Tim Young made a motion to grant the application of Ronald Hicks to construct a single family 56’ x 36’ home, to be no closer than 8’ from the west property boundary and no closer than 8’ from the east property boundary. On the rear (canal) side, the house is to be no closer than 22’ to the rear boundary, and the deck is to be no closer than 14’ to the rear boundary. Variance is also granted for lot area and lot width. Seconded by Gary Starr. All aye. Carried.
Application of Jerold Reynolds, 2217 Fifth Avenue, Lakewood, New York, for an area variance for a garage addition. Property is owned by him and known as Section 384.12, Block 1, Lots 1-8 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Doug Hooper made a motion to grant the application of Jerold Reynolds for a garage addition. A variance of 5’ is granted for the front yard setback, and the garage is to be no closer than 5’ to the north property boundary and no higher than 28’. Seconded by Tim Young. All aye carried.
Upon motion made by Tim Young, the meeting was adjourned at 7:48 pm.
