A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, July 24, 2019 at 7:00 p.m. at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following applications:
Application of John P. Strand, PO Box 424, Ashville, New York, to renew a special use permit to operate a self-storage facility at 4748 Cramer Drive, Ashville, New York. Property is owned by him (Lakewood-Busti Properties, LLC) and known as Section 401.00, Block 2, Lot 3.2 of the official tax map of the Town of Busti. Property is in the Light Manufacturing and Research and Development District. Mr. Strand was in attendance and noted that there have been no changes in the operation of the business. Doug Hooper made a motion to grant the application of John P. Strand to renew a special use permit to operate a self-storage facility at 4748 Cramer Drive, Ashville, New York. The permit will be issued as granted previously and will be for a three-year term. Seconded by Tim Young. All aye. Carried.
Application of Greg Wagner, Orchard Park, New York for an area variance for a covered deck at 2460 Lakeside Drive, Ashville, New York. Property is owned by him and known as Section 367.20, Block 4, Lots 20 and 21 of the official tax map of the Town of Busti. Property is in the Multi-Family Residential District. The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Gary Starr made a motion to grant the application of Greg Wagner for a covered deck, with the stipulations that it is to be an open deck (no railings) and the existing trees will be cut up to the level of the eaves of the house. A variance of 60’ is granted for lot width. A variance of 3.5’ is granted for the west side yard boundary. The deck is to be no closer than 17’ to the rear property boundary, and no wider than the width of the house. Seconded by Tim Young.

Application of Tom Allen, 1980 Winch Road, Lakewood, New York for an area variance for an addition to an existing house. Property is owned by him and known as Section 402.00, Block 1, Lot 37 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Tim Young made a motion to grant the application of Tom Allen for an addition. A variance of 50’ is granted for lot width. Seconded by Scott Schang. All aye. Carried.
Application of William Reading, Cleveland, Ohio for an area variance to relocate and replace a garage at 42 Loomis Bay Road, Ashville, New York. Property is owned by him and known as Section 367.15, Block 2, Lot 7 of the official tax map of the Town of Busti. Property is in the Multi-Family Residential District. Tim Young made a motion to table the application of William Reading until the next meeting on August 28, 2019. Seconded by Douglas Hooper. All aye. Carried.
Application of Jennifer Wiltsie, 2477 Lakeside Drive, Ashville, New York for an area variance for a garage. Property is owned by her and known as Section 367.20, Block 3, Lot 7 of the official tax map of the Town of Busti. Property is in the Multi-Family Residential District. Tim Young made a motion to table the application of Jennifer Wiltsie until the next meeting on August 28, 2019. Seconded by Douglas Hooper. All aye. Carried.
Application of Mark Cartwright, Stow, Ohio for an area variance to change a roof pitch on property located at 2420 Keller Road, Ashville, New York. Property is owned by him and known as Section 367.20, Block 2, Lot 57 of the official tax map of the Town of Busti. Property is in the Multi-Family Residential District. The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Tim Young made a motion to grant the application of Mark Cartwright to change the roof pitch on his existing house. Seconded by Scott Schang. All aye. Carried.
Upon motion made by Tim Young, the meeting was adjourned at 8:15 pm.
