A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, January 27, 2021 at 6:30 pm via video/teleconference at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following applications:
Application of Salvatore Liuzzo, Jamestown, New York for an area variance to construct an addition on property located at 2495 Lakeside Drive, Ashville, New York. Property is owned by him and known as Section 367.20, Block 3, Lots 3, 4 and 5 of the official tax map of the Town of Busti. Property is in the Multifamily/Residential District. The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Scott Schang made a motion to grant the application of Salvatore Liuzzo for an addition. Variance is granted for .3 acre for lot size and 34’ on the rear yard dimension, with the addition to be no closer than 16’ to the rear boundary. Seconded by Tim Young. All aye. Carried.
Application of Ralph Smith Jr., 1870 Shadyside Road, Lakewood, New York, for an area variance to construct a garage. Property is owned by him and known as Section 402.00, Block 2, Lot 25 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. Mr. Smith was in attendance and The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Bruce Kidder made a motion to grant the application of Ralph Smith Jr. for a 20’ x 20’ garage. A variance of 5’ is granted on the north side, with the garage to be no closer than 35’ to the north side property boundary. Seconded by Tim Young. All aye. Carried.
Revisiting the application of Alex Herlovitch and Camille Wicher, Depew, New York, whose variance for a second story addition to their property at 2496 Lakeside Drive, Ashville, New York was granted in September 2020, Tim Young noted that when granting the variance, the Board failed to address the location of the addition on the west side yard. Tim Young made a motion to amend the variance to include that the addition is to be no closer to the west side boundary than the existing building. Seconded by David Josephson. All aye. Carried.
Upon motion made by Tim Young, the meeting was adjourned at 6:45 pm.
