A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, February 24, 2021 at 6:30 pm in-person and via video/teleconference at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following applications:
Application of Kelby Feldt, 1469 Shadyside Road, Lakewood, New York, for an area variance to construct a garage. Property is owned by him and known as Section 402.00, Block 3, Lot 42 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. Mr. Feldt was in attendance and explained his plans to construct a 32’ x 40’garage initially and add a 14’ x 40’ lean-to on the north side later. The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Tim Young made a motion to grant the application of Kelby Feldt to construct a garage with an attached lean-to, to be no closer than 10’ to the north side property boundary. Variance is also granted for 40’ for lot width and .7 acre lot size. Seconded by Bruce Kidder. All aye. Carried.
Application of Janet Stanek, 2477 Keller Road, Ashville, New York for an area variance to construct a semi-inground pool. Property is owned by her and known as Section 367.20, Block 1, Lot 83 of the official tax map of the Town of Busti. Property is in the Multifamily/Residential District. Ms. Stanek was in attendance and explained her intent to erect a fence on the lot line and have the pool approximately 6 inches from the fence. The Board discussed the need to maintain at least 5’ from side property boundaries for fire department access and indicated the variance could not be approved at the requested lesser distance. Scott Schang made a motion to deny the variance application of Janet Stanek for a semi-inground pool. Seconded by David Josephson. All aye. Carried.
Upon motion made by Tim Young, the meeting was adjourned at 6:55 pm.
