A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, August 25, 2021, at 6:30 pm at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following applications:
Application of Robert Harber, 2437 Keller Road, Ashville, New York for an area variance for a second-floor addition. Property is owned by him and known as Section 367.20, Block 1, Lots 66 & 67 of the official tax map of the Town of Busti. Property is in the Multi-Family Residential District. The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Gary Starr made a motion to grant the application of Robert Harber for a second story addition. Variances are granted for the addition to be 3’ from the south side property boundary, 20.5’ from the north side property boundary, and 25’ from the rear boundary. Variance is also granted for 22,500 square feet for lot size and 62.5’ for lot width. Seconded by Bruce Kidder. All aye. Carried.
Application of Richard Froah, 1134 Hunt Road, Lakewood, New York for an area variance for a shed. Property is in the Conservation/Residential District, owned by him and known as Section 385.00, Block 1, Lot 28 of the official tax map of the Town of Busti. The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Tim Young made a motion to grant the application of Richard Froah for a 12’ x 24’ shed. A variance of 8’ is granted on the west side property boundary. Variance is also granted for one acre for lot size and 100’ for lot width. Seconded by Scott Schang. All aye. Carried.
Application of Richard Severtson, 3251 Donelson Road, Jamestown, New York for an area variance for a shed. Property is in the Conservation/Agricultural District, owned by him and known as Section 437.00, Block 2, Lot 7 of the official tax map of the Town of Busti. The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Bruce Kidder made a motion to grant the application of Richard Severtson for a shed. A variance of 28’ is granted on the east side property boundary. Variance is also granted for .178 acre for lot size and 25’ for lot width. Seconded by Tim Young. All aye. Carried.
Application of Adrian Williams, Randolph, New York, for an area variance for a covered deck at 2898 Garfield Road, Jamestown, New York. Property is owned by Steven and Susan Arnold and known as Section 404.01, Block 3, Lot 33 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Tim Young made a motion to grant the application of Adrian Williams for an area variance for a 24’ x 24’ partially covered deck. Variance is granted for one acre for lot size and 100’ for lot width. Seconded by Scott Schang. All aye. Carried.
Upon motion made by Tim Young, the meeting was adjourned at 6:55 pm.
