Zoning Board of Appeals Chairman, Tim Young, announced the next Zoning Board of Appeals meeting will be held, Wednesday, December 8th at 6:30. This meeting will be the last meeting in 2021.

A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, October 27, 2021, at 6:30 pm at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following applications:

Application of Juma Nadi, 3695 Baker Street Extension, Lakewood, New York for an area variance for a 12’ x 24’ shed.  Property is in the Conservation/Residential District, owned by him and known as Section 403.00, Block 1, Lot 32 of the official tax map of the Town of Busti. The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Tim Young motioned to grant the application of Juma Nadi for a 12’ x 24’ shed. The variances granted include 150 feet lot width and 30 feet on the east side yard. Motion was duly moved by Scott Schang. All in favor, carried.

Application of Harold Devlieger, 2449 Lakeside Drive, Ashville, New York for an area variance for a shed.  Property is owned by him and known as Section 367.20, Block 3, Lot 18 of the official tax map of the Town of Busti. Property is in the Multi-Family Residential District.  The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Scott Schang motioned to grant the application of Harold Devlieger for a 8’ x 8’ shed. The variances granted include lot area of 25,000 square feet, lot width of 72 feet, lot coverage of 13%, and 9 feet to the northwest corner side yard. The shed would be located 12 feet off the canal. Motion was duly moved by Dave Josephson. All in favor, carried.

Application of Kenneth and Sherrie Crosby, Russell, Pennsylvania for an area variance for an addition and a roof over a deck on property located at 4436 West Fairmount Avenue, Lakewood, New York.   Property is owned by them and known as Section 385.05, Block 3, Lots 11 & 12 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Tim Young moved to grant the application of Kenneth and Sherrie Crosby for an addition and roof over a deck. The variance granted is for 14 feet rear yard dimension. Motion was duly moved by Scott Schang. All in favor, carried.

Application of Ryan Colburn, 1733 Park Meadow Drive, Jamestown, New York for an area variance for a garage addition.  Property is in the Conservation/Residential District, owned by him and known as Section 403.00, Block 1, Lot 32 of the official tax map of the Town of Busti. The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Tim Young moved to grant the application of Ryan Colburn for a garage addition. The variances granted include 1.4 acres for lot area, 88.8 feet for lot width, and 16 feet side yard on the north side. Motion was duly moved by Scott Schang. All in favor, carried.

Application of Linda Fye, 1966 Winch Road, Lakewood, New York for an area variance for an attached garage and 12’ x 20’ shed.  Property is in the Conservation/Residential District, owned by her and known as Section 402.00, Block 1, Lot 36 of the official tax map of the Town of Busti. The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Tim Young moved to grant the application of Linda Fye for an attached garage and a shed. The variances granted include 50 feet lot width and 28 feet south side yard for the shed. Motion was duly moved by Scott Schang. All in favor, carried.

Upon motion made by Tim Young, the meeting was adjourned at 6:55 pm.
