A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, September 22, 2021, at 6:30 pm at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following application:
Application of Michael Hanselman, 815 Big Tree Road, Jamestown, New York for a use variance to operate a firearm training facility and shooting range. Property is in the Conservation/Agricultural District, owned by him and known as Section 419.00, Block 1, Lot 35 of the official tax map of the Town of Busti. Mr. Hanselman was in attendance and explained his proposal to the Board. Chairman Tim Young noted receipt of a letter relative to this application from Chautauqua County Department of Planning and Economic Development, finding that “…the proposed action would not have a significant county-wide or inter-community impact and that the proposal would be a matter of local concern.”, as well as three letters from neighbors of Mr. Hanselman, one in favor of his application and two against.
The Board reviewed the test for obtaining a use variance and determined that Mr. Hanselman failed to prove that applicable zoning regulations and restrictions have caused unnecessary hardship. Tim Young motioned to deny Michael Hanselman’s application for a firearm training facility and shooting range. Seconded by Bruce Kidder. All aye. Carried.
Upon motion made by Tim Young, the meeting was adjourned at 7:05 pm.
