A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, July 27, 2022, at 6:30 pm at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following applications:

Application of Jeff Fisher, Chardon, Ohio for an area variance to replace a garage on property located at 26 Loomis Bay Road, Ashville, New York.  Property is owned by him and known as Section 367.15, Block 2, Lot 21 of the official tax map of the Town of Busti.  Property is in the Multi-Family Residential District.  The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood.  Tim Young motioned to grant the application of Jeff Fisher to tear down the old garages and replace with a new garage measuring 24’ x 40’ with a 12’ x 52’ open carport around the building on the west and south sides.  Garage is to have rain gutters to direct runoff.  A variance of 79’ is granted for lot width, 28’ for the rear property boundary, and 28’ for the front property boundary.  Side property boundary variances of 9’10” on the east side boundary and 9’9” on the west side are also granted.  Seconded by Bruce Kidder.  All aye, carried.

Application of Marguerite Hogg, Angola, New York, for an area variance for a shed on property located at 2330 West Lake Road, Ashville, New York.  Property is owned by her and known as Section 384.08, Block 1, Lots 20-22 of the official tax map of the Town of Busti.  Property is in the Lakeshore Commercial District.  The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood.  Bruce Kidder motioned to grant the application of Marguerite Hogg for a shed.  A 3’ variance is granted on the east side property boundary.  Seconded by Gary Starr.  All aye, carried.

Application of Alan and Cynthia Lamb, 1742 Park Meadow Drive, Jamestown, New York for an area variance for an addition.  Property is in the Conservation/Residential District, owned by them and known as Section 403.08, Block 2, Lot 15 of the official tax map of the Town of Busti.  The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood.  Tim Young motioned to grant the application of Alan and Cynthia Lamb for a 14’ x 28’ addition.  A variance of 17’ is granted on the southeast side property boundary.  Variance is also granted for 1.4 acre for lot size and 85’ for lot width.  Seconded by Gary Starr.  All aye, carried.

Upon motion made by Tim Young, the meeting was adjourned at 7:20pm.
