Chairman Paterniti reviewed the motions from September 2nd‘s Planning Board meeting on the application of Southern Tier Brewing Co. for Phase 3 and Phases 4 &5. He noted that the site plan has been modified to eliminate the encroachment on the wetlands and the application was referred to Chautauqua County Department of Planning & Economic Development who found the project to be a matter of local concern. The department encouraged the town to reevaluate the appropriateness of its minimum parking requirements for warehousing uses in the Industrial District. Mr. Paterniti added that upon reviewing the application Attorney Joel Seachrist determined that it should be referred to the Zoning Board of Appeals for an area variance requesting a reduced number of required parking spaces. The ZBA met on September 23rd and granted a variance to reduce the number of required parking spots from 150 to 35 additional spots. Combined with the existing parking spots there will be approximately 45 spots for the facility.

Mr. Asinger, Kessel Construction Inc., presented the Phase 3 plan for Southern Tier Brewing Co., Inc. to build a 150’ x 150’ condition warehouse addition on the west side of the existing warehouse. Property is located at 2000 Stoneman Circle, Lakewood, New York owned by them and known as Section 385.00, Block 1, Lot 45.5 of the official tax map of the Town of Busti. Property is in the Industrial District. James Butler motioned to approve the project pending wetlands determination and review by Joel Seachrist, attorney for the Town of Busti, seconded by Linda Anderson, all aye. Carried.
Zoning Board of Appeals Minutes August 26, 2015
Application of Steve Pikna, 112 Maple Avenue, Oil City, PA for an area variance for a roof over an existing porch of a home owned by him and known as Section 367.15, Block 2, Lot 39 of the official tax map of the Town of Busti. The home is on property located at 11 Loomis Lane, Ashville, New York, owned by Scorse-Loomis Bay Properties, LLC and known as Section 27, Block 1, Lot 1.15.S001 of the official tax map of the Town of Busti. Property is in the Multi-Family Residential District. The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Richard Nygren made a motion to grant the application of Steve Pikna for a 14’4” x 6’ roof over an existing porch. Roof will cover the porch with no change to the footprint, and porch will be screened in. Seconded by Tim Young. All aye. Carried.
Zoning Board of Appeals Minutes July 22, 2015
Application of Daniel T. Byers, 8 Curtis Street, Jamestown, New York for a Special Use Permit for a camp on property on the corner of Donelson Road and South Main Street Extension, Jamestown, New York. Property is owned by him and is known as Section 438.00, Block 2, Lot 26 of the official tax map of the Town of Busti. Property is in the Conservation/Agricultural District. Mr. Byers was in attendance and explained his intention to use the property for family recreation, primarily in the summertime. The issue of the use of a camper on the property was deliberated, with the Board determining that such use is not expressly permitted in the town code.
