A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, July 27, 2016 at 7:00 p.m. at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following application:

Application of Cynthia Robbins, 239 Catlin Hill Road, Sugar Grove, Pennsylvania for an Area Variance to install a pre-built shed. Property is owned by her, located at 887 Busti Sugar Grove Road, Jamestown, New York, and known as Section 420.18, Block 1, Lot 18 of the official tax map of the Town of Busti.  Property is in the Highway Commercial District.  The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Gary Starr made a motion to grant the application of Cynthia Robbins to install a 10’ x 12’ pre-built shed. The variance is required due to lot size and lot frontage. Motion was seconded by Kathy Stedman. All aye. Carried

Application of Randall and Margherita Jackson, 1606 Shadyside Road, Lakewood, New York for an Area Variance to build a detached garage.  Property is owned by them and known as Section 402.00, Block 3, Lot 26 of the official tax map of the Town of Busti.  Property is in the Conservation Residential District.  The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Douglas Hooper made a motion to grant the application of Randall and Margherita Jackson to construct a garage. The variance is required due to lot size and the side setback. The garage will be 28’ x 36’ and will be located no closer than 13’ from the south boundary. Motion was seconded by Tim Young. All aye. Carried

Upon motion made by Douglas Hooper, the meeting was adjourned at 7:14 p.m.
