You are here: Home / Town News / Zoning Board of Appeals November 30, 2016Zoning Board of Appeals Minutes November 30, 2016 Present: Tim Young, Chairman Richard Nygren Douglas Hooper Gary Starr Kathy Stedman Also present: Chelsea Winchester and Richard DeVlieger A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, November 30, 2016 at 7:00 p.m. at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following application: Application of Jonathan Winchester, 910 Hunt Road, Lakewood, New York for an area variance to construct a front entryway addition. Property is owned by him and known as Section 385.04, Block 1, Lot 5 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Douglas Hooper made a motion to grant the application of Jonathan Winchester to construct a front entryway addition. The addition will be 8’x10’ and enclosed with three steps to the entrance. Seconded by Gary Starr. All aye. Carried. Application of Richard Devlieger, 1600 Shadyside Road, Lakewood, New York for an area variance for a deck and a shed. Property is owned by him and known as Section 402.00, Block 3, Lot 27 & 28 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Richard Nygren made a motion to grant the application of Richard Devlieger to replace a concrete patio with a 8’x46’ treated wood deck including the steps, the deck will have a 5’ overhang and will not exceed the north side of the existing house; and to place a 10’x20’ pre-built wood shed at the southwest side of the existing home, the shed will be located on both lot 27 & 28 and be no closer than 40’ to the south boundary of lot 27. Seconded by Douglas Hooper. All aye. Carried. Upon motion made by Tim Young, the meeting was adjourned at 7:25 p.m. Respectfully given, ____________________________ Darlene H. Nygren, Town Clerk
