A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, September 27, 2017 at 7:00 p.m. at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following applications:

Application of Debora Thayer, Ashville, New York, for a sign variance to place a directional sign at the intersection of Routes 394 and 474, Ashville, New York.  Property is owned by Neil Boardman and is known as Section 384.08, Block 1, Lot 48 of the official tax map of the Town of Busti.  Property is in the Gateway Commercial District.  The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood.  Doug Hooper made a motion to grant the application of Debora Thayer for a directional sign.  The two-sided aluminum sign will be unlit, permanent, and no larger than 32 square feet.  It will be located 25 feet from Route 394 and 25 feet from Route 474, at the point where those measurements meet.  All other existing signs at that location will be removed.  Seconded by Kathy Stedman.  All aye.  Carried.

Application of Joseph Cali, 1879 South Maple Avenue, Ashville, New York for an area variance for a shed.  Property is owned by him and known as Section 384.19, Block 1, Lot 32 of the official tax map of the Town of Busti.  Property is in the Conservation/Residential District.  The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood.  Gary Starr made a motion to grant the application of Joseph Cali for a 10’ x 16’ shed, to be located no closer than 18’ to the north side property boundary.  Shed is to be used only for storage.  Variance is also granted for lot size and lot width.  Seconded by Tim Young.  All aye.  Carried.

Application of Bruce and Susan Fulton, Lakewood, New York for a special use permit for a camp on property located at 4088 Baker Street Extension, Lakewood, New York.  Property is owned by B & S Fulton Family Trust I and is known as Section 402.00, Block 1, Lot 41.1 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District. Tim Young made a motion to deny the application of Bruce and Susan Fulton for a special use permit for a camp, but noted that storage of the travel trailer on the property is permitted.  Seconded by Kathy Stedman. All aye. Carried.

Application of Howard Linamen, 4587 Baker Street Extension, Lakewood, New York, for an area variance to install solar panels.   Property is owned by him and known as Section 401.00, Block 2, Lot 28 of the official tax map of the Town of Busti. Property is in the Conservation/Residential District.  The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood.  Tim Young made a motion to grant the application of Howard Linamen to install solar roof panels.  Variance is granted for lot width.  Seconded by Douglas Hooper.  All aye.  Carried

Upon motion made by Tim Young, the meeting was adjourned at 7:48 p.m.

Respectfully given,
