Also present: Leona Anderson, Ronald Schifano, Greg Edwards, Code Enforcement Officer Jeffrey Swanson

A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, March 28, 2018 at 7:00 p.m. at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following applications:

Application of Larry Wagner, Mayville, New York for renewal of his special use permit for a camp at 4831 Sandstrom Road, Ashville, New York. Property is owned by him and is known as Section 435.00, Block 2, Lot 1.1 of the official tax map of the Town of Busti. Property is in the Conservation/Agricultural/Mobile Home Park District. Tim Young made a motion to grant the application of Larry Wagner for a renewal of a special use permit for a camp. The term of the renewal is three years. Seconded by Gary Starr. All aye. Carried.

Application of Leona Anderson, 4365 West Summit Avenue, Lakewood, New York, for renewal of her special use permit to use the existing building located at 4370 West Fairmount Avenue, Lakewood, New York, for selling ice cream. Property is in the Conservation/Residential District, owned by her and known as Section 385.05, Block 4, Lot 64 of the official tax map of the Town of Busti. Doug Hooper made a motion to grant the application of Leona Anderson for a renewal of her special use permit to use the existing building located at 4370 West Fairmount Avenue, Lakewood, New York, for selling ice cream. The term of the renewal is three years. Seconded by Kathy Stedman. All aye. Carried.

Application of Ronald Schifano, 1352 Orr Street, Jamestown, New York, for a renewal of a special use permit for a generator. Property is in the Conservation/Residential District, owned by him and known as Section 420.00, Block 3, Lot 55 of the official tax map of the Town of Busti. Tim Young made a motion to grant the application of Ronald Schifano to renew a special use permit for a generator at 1352 Orr Street, Jamestown, New York. The term of the renewal is three years. Seconded by Scott Schang. All aye. Carried.

Application of Louis R. LaLonde, d/b/a Copy Quik Printing, 4384 West Fairmount Avenue, Lakewood, New York, for renewal of a special use permit to operate a digital imaging and photograph service at that location. The property is in the Conservation/Residential District, is owned by him and is known as Section 385.05, Block 4, Lots 68 & 69 of the official tax map of the Town of Busti. Tim Young made a motion to grant the application of Louis R. LaLonde, d/b/a Copy Quik Printing, for renewal of a special use permit to operate a digital imaging and photograph service. The term of the renewal is three years. Seconded by Scott Schang. All aye. Carried.

Application of Gregory J. Edwards, 3606 Nutt Road, Jamestown, New York for an area variance to construct a tool barn. Property is owned by him and known as Section 420.18, Block 1, Lot 22.5 of the official tax map of the Town of Busti. Property is in the Conservation/Agricultural District. The Board reviewed the balancing test and determined that the benefit to the applicant outweighed any detriment to the neighborhood. Scott Schang made a motion to grant the application of Gregory J. Edwards for a 40’ x 60’ barn on said property. The barn is to be no closer than 10’ to the east side yard property boundary. Seconded by Tim Young. All aye. Carried.

Upon motion made by Tim Young, the meeting was adjourned at 7:35pm.
