Zoning Board of Appeals Minutes

October 28, 2020

    David Josephson

A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, October 28, 2020 at 6:30 pm at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following applications:

Application of Gary and Rhonda Hinman, 3171 Donelson Road, Jamestown, New York for an area variance for a shed.  Property is owned by them and known as Section 437.00, Block 2, Lot 15 of the official tax map of the Town of Busti.  Property is in the Conservation/Agricultural District.  Mr. Hinman appeared and discussed the desired placement of the storage shed on said parcel.  The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood.  Scott Schang made a motion to grant the application of Gary and Rhonda Hinman for a shed.  A variance of 26’ on the rear yard property boundary is granted.  Seconded by David Josephson.  All aye.  Carried.

Application of Matt Carnes, 4679 Lawson Road, Ashville, New York for a special use permit to run a home-based business as an FFL (Federal Firearms License) dealer.  Property is owned by him and Erin Carnes and known as Section 435.00, Block 2, Lot 25 of the official tax map of the Town of Busti.  Property is in the Conservation/Agricultural District.  Mr. Carnes was in attendance and discussed his proposed business plan.  He indicated that he will not be keeping product or merchandise in stock, and the only traffic would be a customer picking up an order.   Tim Young made a motion to grant the application of Matt Carnes for a special use permit to operate a home-based business as an FFL dealer.    There will be no shooting range on the premises and off-street parking will be provided.  Seconded by Gary Starr.  All aye.  Carried.

Upon motion made by Tim Young, the meeting was adjourned at 6:50 pm.
