Town Board Special Meeting – January 11, 2021

SPECIAL MEETING

January 11, 2021

A special meeting of the Town Board of the Town of Busti was held on Monday, January 11, 2021 at 5:00 p.m., via teleconference (publication is on file) with the following members present:

Supervisor Jesse M. Robbins

Councilman Todd Hanson

Councilman Jim Andrews

Councilman Paul Gustafson

Councilman Doug Brown

Supervisor Robbins called the meeting to order and thanked everyone for calling in.

Present at the meeting were: None

Supervisor Robbins noted the moratorium on Utility Distribution Facilities expires on January 31, 2021. The board would like to extend the moratorium for six months.

Supervisor Robbins motioned the following resolution which was duly moved by Councilman Hanson:                                    RESOLVED, the Town of Busti Town Board set a public hearing to be held on February 1, 202 at 7:00 p.m. regarding the adoption of Local Law No. 1 for the year 2021, which extends a moratorium on municipal approvals for Utility Distribution Facilities through July 31, 2021.

Upon roll call vote, all aye, carried.

Supervisor Robbins noted he had been contacted by a Kiantone resident inquiring about hooking up to the S. Main Street Water District because they had extreme water issues; they lived across the street from the water district and the Town of Kiantone does not have a water district near them with no intention of developing one soon. Supervisor Robbins contacted the City of Jamestown regarding the matter; the City of Jamestown agreed to allow the Kiantone resident to hookup to the S. Main Street water district according to the following Water Sale Agreement.

Supervisor Robbins motioned the following resolution which was duly moved by Councilman Hanson:

RESOLVED, the Town of Busti establish an agreement with Daryl and Kaitlin Damcott and the Town of Busti Town Board authorize Supervisor Robbins to sign the agreement.

Upon roll call vote, all aye, carried.

WATER SALE Agreement

THIS AGREEMENT, made and entered into this _____ day of January, 2021, between the Town of Busti, a municipal subdivision of the State of New York situate in Chautauqua County, having its offices at 125 Chautauqua Avenue, Lakewood, New York 14750, acting for and on behalf of the Town of Busti Water District No. 5 (hereinafter “Town” or “Water District”), and Daryl M. Damcott and Kaitlin M. Landy, of 1642 Souith Main Street Extension, Jamestown, New York 14701, (hereinafter referred to, collectively, as “Owner”).

witnesseth:

WHEREAS, the Owner owns real property in the Town of Kiantone on South Main Street Extension described as follows:

Section 404.00, Block 2, Lot 50

(hereinafter referred to as the “Premises”), and

WHEREAS, Owner has requested permission to connect to the District’s watermain running along South Main Street to supply water to the Premises,

NOW, THEREFORE, the parties agree as follows:

  1. Sale & Purchase of Water. Water District agrees to sell and the owner agrees to buy water solely for use on the premises through a metered connection, made and maintained by Owner in accordance with the Rules & Regulations of the Water District and any other applicable rules or instructions of the Town of Busti.
  2. Water Rate. Owner agrees to pay the same water rates, fees, and charges as does any other user in the Water District.
  3. Connection Charge. Upon the signing of this Agreement, Owner agrees to pay the District a connection charge of $6,500.00. In all other respects in the future, Owner shall be treated as and assessed the same charges and fees as any other resident of the Water District except for any prior capital costs incurred by the District..
  4. Notices. Any and all notices and payments required hereunder shall be addressed as follows, or to such other address as may hereafter be designated in writing by either party hereto:

  1. Waiver. No waiver of any breach of any condition of the agreement shall be binding unless in writing and signed by the party waiving said breach. No such waiver shall in any way affect any other term or condition of this agreement or constitute a cause or excuse for a repetition of such or any other breach unless the waiver shall include the same.
  2. This agreement constitutes the complete understanding of the parties. No modification of any provisions thereof shall be valid unless in writing and signed by both parties.
  3. This agreement is governed by the laws of the State of New York.

The board discussed the need to establish a policy in personnel returning to work after a mandatory COVID quarantine.

Supervisor Robbins moved the following resolution which was duly moved by Councilman Gustafson:

RESOLVED, the Town of Busti Town Board set a policy for personnel returning to work after a mandatory COVID quarantine. The person returning must receive a “Release from the Mandatory Isolation” from Chautauqua County Health Department or another New York State authorized entity; prior to their return, the release document should be given to their immediate supervisor who should then inform the Town Supervisor of the release and provide a copy of the release to the Bookkeeper to be filed in the individual’s personnel file. In addition, the Town of Busti Town Board recommends that all employees wear a mask anytime they are away from their individual workstation throughout the workday.

Upon roll call vote, all aye, carried.

Town Clerk Nygren presented a quote from Kistler – A Stark Tech Group Company for three Healthway Deluxe – Professional 9-Stage DFS Air Purification Systems. The systems remove 99.99% of harmful viruses, fungi molds, and bacteria dow to .007 micron in size. The cost per unit is $750; Councilman Hanson noted the cost of the units should be refundable through FEMA.

Supervisor Robbins moved the following resolution which was duly moved by Councilman Andrews:

RESOLVED, the Town of Busti purchase three Healthway Deluxe Air Purification Systems from Kistler at a cost of $750 per unit. The units will be placed in the Town Clerk’s office, the Court Clerk’s office, and the Highway breakroom; a unit can be easily transferred to the court/boardroom for anytime court is in session or there is a public meeting.

Upon roll call vote, all aye, carried.

The board discussed COVID concerns of non-employee unauthorized persons entering the Town Clerk and Court Clerk offices.

Supervisor Robbins motioned the Town Board establish a policy stating until further notice, no non-employee unauthorized persons be allowed to enter either the Town Clerk and/or Court Clerk offices without preauthorization, motion was duly moved by Councilman Gustafson.

All in favor, carried.

The board continued discussing the importance of all officials and employees to maintain social distancing and wear masks throughout the work week.

The next board meeting is scheduled for February 1, 2021; the board will meet in person, however due to COVID concerns the public will not be permitted to attend in person. The public can attend the meeting virtually or via telephone, the access information will be posted on the town’s website www.townofbusti.com under “Announcements”.

Supervisor Robbins moved to adjourn the regular meeting at 5:38 p.m. which was duly moved by Councilman Andrews.
