March 24, 2021

A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, March 24, 2021 at 6:30 pm in-person and via video/teleconference at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, to consider the following applications:

Application of Ron and Joanne Kushner, Oil City, Pennsylvania, for an area variance for an addition on property owned by them, located at 8 Loomis Lane, Ashville, New York and known as Section 367.15, Block 2, Lot 42 of the official tax map of the Town of Busti.  Property is in the Multi-Family Residential District.  Mr. & Mrs. Kushner were in attendance and discussed the proposed addition.  The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed any detriment to the neighborhood.  Tim Young made a motion to grant the application of Ron and Joanne Kushner to construct an addition.  On the west side, the addition will be the same distance as the house to the property boundary, and on the east side it will be 9’ from the property boundary.  Variance is also granted for 95.35’ for lot width and 22,200 square feet for lot size.  Seconded by Bruce Kidder.  All aye.  Carried.

Application of Dallas Scherrer, Washington, Pennsylvania, for an area variance for an addition on property owned by him, located at 102 Creekside Lane, Ashville, New York and known as Section 367.15, Block 2, Lot 68 of the official tax map of the Town of Busti.  Property is in the Multi-Family Residential District.  Mr. Scherrer was in attendance and explained that the addition is already built and there was miscommunication with the contractor about the permit.  He also indicated there are several construction issues that need to be addressed.  David Joshephson made a motion to table the application of Dallas Scherrer until the next scheduled Zoning Board of Appeals meeting on April 28, 2021.  Seconded by Bruce Kidder.  All aye.  Carried.

Upon motion made by Tim Young, the meeting was adjourned at 7:27 pm.
