May 26, 2021

A public hearing before the Zoning Board of Appeals of the Town of Busti was held on Wednesday, May 26, 2021 at 6:30 pm in-person and via video/teleconference at the Town of Busti Administration Building, 125 Chautauqua Avenue, Lakewood, New York, where the following applications were considered:

 

Application of Randall Delahoy, 4342 Nutt Road, Jamestown, New York for renewal of a special use permit for a seasonal camp on said property.  Property is in the Conservation Agricultural District, owned by him and known as Section 419.00, Block 2, Lot 51 of the official tax map of the Town of Busti.  Mr. Delahoy was in attendance and stated that there are no changes to the camp since his original application was approved in 2018.  Bruce Kidder motioned to grant the renewal application of Randall Delahoy for a camp at 4342 Nutt Road.  The conditions of the original permit apply, allowing Mr. Delahoy’s camper plus six additional campers, to be in use for the holiday season running from Memorial Day plus 100 days, with the proper septic/sewage facilities set up, checked weekly.  Mr. Delahoy is to contact the Chautauqua County Health Department to ensure he is compliant with County regulations.  Seconded by Tim Young.  All aye.  Carried.

 

Application of Terence and Heidi Couchenour, 800 Hunt Road, Lakewood, New York for an area variance for a garage addition.  Property is owned by them and known as Section 385.04, Block 1, Lot 31 of the official tax map of the Town of Busti.  Property is in the Conservation/Residential District.  The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed the detriment to the neighborhood. Tim Young motioned to grant the application of Terence and Heidi Couchenour for a garage addition.  A variance of 1.2 acres is granted for lot size and 108’ for lot width.  Seconded by Scott Schang.  All aye.  Carried.

 

Application of David Crawford, 4724 Gleason Road, Ashville, New York for an area variance for a shed. Property is owned by him and is known as Section 384.00, Block 3, Lot 42 of the official tax map of the Town of Busti.  Property is in the Conservation/Residential District. The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed the detriment to the neighborhood. Scott Schang motioned to grant the application of David Crawford for a shed, to be no closer than 5’ to the property boundary.  A variance of .24 acres is granted for lot size.  Seconded by Gary Starr.  All aye.  Carried.

 

 Application of Elizabeth and Kenneth Kaltenbach, 4678 Ashville Road, Ashville, New York for an area variance for an addition.  Property is owned by them and known as Section 384.11, Block 2, Lot 15 of the official tax map of the Town of Busti.  Property is in the Conservation/Residential District.  The Board reviewed the balancing test for a variance and determined that the benefit to the applicant outweighed the detriment to the neighborhood. Scott Schang motioned to grant the application of Elizabeth and Kenneth Kaltenbach for an addition.  A variance of 184’ is granted for lot width and 1.58 acres for lot size.  A 30’ variance is granted on the east side property boundary and a 20’ variance is granted on the west side boundary.  Seconded by Tim Young.  All aye.  Carried.

 

Upon motion made by Tim Young, seconded by Gary Starr, the meeting was adjourned at 7:11 pm.
